The subject of the proceedings is the supply of 1 minibus for transporting at least 9 people together with a driver for the Provincial Headquarters of the State Fire Service in Olsztyn for the organisational unit of the State Fire Service of the Warmińsko-Mazurskie Province. The technical description of the subject-matter of the contract is attached as Annex 4 to the FTZ. 3. The Contractor undertakes to perform the subject-matter of the contract in accordance with the rules set out in the tender documentation, including the model contract (Annex 3 to the FTZ). 4. The subject of the contract is to be brand new, unused, technically efficient, safe, in accordance with applicable standards and quality standards, complete and ready for use, and must meet the minimum technical, functional and quality requirements specified in the tender documentation. 5. Any names (trade marks), standards, evaluations and technical specifications provided by the Ordering Party in the description of the subject of the contract are illustrative, and their indication is aimed at determining the expected standard, while the Ordering Party allows the submission of equivalent offers pursuant to Art. 4, 5, 6 of the Public Procurement Law in conjunction with Article 99 of the Public Procurement Law. If specific standards, assessments and technical specifications are indicated in the documentation of the procedure, the Contracting Authority shall inform that it allows the use of equivalent solutions described by these standards. The Contractor who relies on equivalent solutions described by the Ordering Party is obliged to demonstrate in the tender - in particular by means of the evidence in question - that the supplies offered by him meet the requirements specified by the Ordering Party. Trademarks, patents or origins, sources or specific processes indicated in the documentation, which characterise the origin of materials, devices, services - serve as auxiliary, the use of materials, devices and other products "equivalent" is allowed, provided that technical parameters equal or better than those obtained through the implementation of the description of the subject of the contract are obtained. The Contractor who refers to solutions ‘equivalent’ to those described by the Ordering Party is obliged to demonstrate that the products and equipment offered by him meet the requirements specified by the Ordering Party. In this case, the tender must be accompanied by a description of the proposed product, the appliance, together with its technical characteristics and the name of the manufacturer. If the Contractor proposes an equivalent product, this must be indicated in the tender.
