The purpose of applying this public procurement procedure is to conclude the works contract in order to achieve the investment objective ‘Non-permanent accumulation Corbești, Bihor County’ – REST TO BE EXECUTED in accordance with the requirements of the Tender Specifications and the Tender Documentation, in compliance with the legislation in force and the Community regulations. The non-permanent accumulation of Corbești, with the main role of attenuating flood waves, is classified in class III of importance cf. STAS 4273/83 and sized according to STAS 4068/87 at calculation flow Q2% and checked at Q0.5%. According to NTLH 21, the dam falls under category C, normal, current tracking RB=0,245. Capacities approved by the Technical and Economic Indicators of the Investment Objective ‘Non-permanent Accumulation Corbești, Bihor County’: - Non-permanent accumulation 2.3 million cubic meters; - Deviation of road 1.81 km.; The execution time for the rest of the investment is 36 months. The conclusion of the contract is subject to the conditions laid down in the standstill clause. SUSPENSIONAL CLAUSIS: The procedure for the award of public contracts is initiated under this standstill clause, in the sense that the conclusion of the public contract for each lot awarded is subject to the allocation of budget appropriations for this purpose, the contract being signed in compliance with the provisions relating to the commitment of expenditure from budgets subject to public finance legislation. Having regard to the provisions of Law No 98/2016 on public procurement and Government Decision No 395/2016, as amended, the Contracting Authority states that it will conclude the contract with the successful tenderer only to the extent that the funds necessary for the procurement will be provided by allocating budgetary commitments/credits for that purpose. If, for any reason, budget commitments/credits will not be allocated, for a period of 6 (six) months from the date of approval of the report of the procedure and/or from the date of final settlement of any disputes, the award procedure will be automatically cancelled, provided that there is no other source of funding, in accordance with the provisions of Article 212(1)(c) sentence 2 of Law 98/2016, as subsequently amended and supplemented, and it is impossible to conclude the public procurement contract. The tenderers in this procedure understand that the Contracting Authority cannot be held liable for any damage in case of cancellation of the award procedure, regardless of its nature and regardless of whether the Contracting Authority has been notified of the existence of such damage. Tenderers in this procedure accept the use of the above special conditions/suspension clause, assuming full responsibility for any damage they may suffer in the situation described. Number of days until which clarifications can be requested before the deadline for submission of tenders/candidates: 20. The contracting authority will respond in a clear and complete manner to all requests for clarifications/additional information on the 11th day before the deadline for the submission of tenders. The contracting authority will respond ONLY to requests for clarifications submitted by the date indicated as the deadline for requesting clarifications.
