Description

Design and realisation of Perpignan/cp.
Article 36 of the Prison Law No 24/11/2009 lays down the obligation to maintain family ties for the benefit of the detainee, which is ensured by means of a number of mechanisms: ‘family parloirs’, ‘family parloirs’ and FMUs. This is the objective of the contract which is the subject of this consultation.
Article 2 of Law No 87-432 of 22 June 1987 on the public prison service, as amended by Law No 2012-409 of 27 March 2012 – Article 2, provides: ‘By way of derogation from Articles 7 and 18 of Law No 85-704 of 12 July 1985 on public project management and its relationship with private project management, the State may entrust a person or group of persons, whether governed by public or private law, with a task relating both to the design, construction and development of penitentiary facilities (...)’.
It is also stated that, because of the characteristics of the operation, and in particular its estimated overall amount, the present procedure is carried out in accordance with Article 28 of the Public Procurement Code (contract awarded in accordance with the adapted procedure) and is based on the provisions applicable to contracts awarded under the design and implementation procedure, without applying them in full (as provided for in Article 69-III of the Public Procurement Code).
The design and production within the Perpignan Prison Centre shall carry:
(a) on the creation of a new building with an extension of approximately 525 square metres on the ground comprising:
1) 34 individual booths (for family parloths)
(2) 3 FMU (3 T2 + 1 T3)
(3) 3 family parloirs.
(b) on rehabilitation with a view to the development of new areas (for details, see II.2.1) of an existing surface area of approximately 650 square metres in the DRC (on a sanitary site).
