1) Service for the collection and management of waste with code 19 12 12 – other waste (including mixed substances and objects) from mechanical treatment of waste other than those mentioned in 19 12 11, i.e. ballast from the sieve fraction resulting from the mechanical treatment of mixed municipal waste, together with a service for the transport of waste from RZUOK in Machnacz, Brześć Kujawski. 2) The total estimated amount of waste with code 19 12 12 intended for collection, transport and management, in the period from the date indicated by the parties in the contract to 31.12.2025, is approx. 14 000 Mg. 3) The estimated amount of waste to be collected, transported and managed in a month is approx. 933 Mg. The monthly estimated amount of waste to be collected may change depending on the needs of the Ordering Party 4) The management of collected waste with code 19 12 12 must take place in accordance with the requirements set out in the Waste Act of 14 December 2012 (Journal of Laws 2023, item 1587), in the recovery and/or disposal operation at the installation indicated by the Contractor in the tender form. 5) In the case of waste disposal through landfilling, the operator must have the status of a municipal installation referred to in Article 35 par. 6 of the Act on Waste (to be on the list of the Marshal of the Province referred to in Art. 1 of the Act of 14 December 2012 on waste). 6) The Contractor in the offer form is obliged to indicate the recovery or disposal process in accordance with Annex 1 and/or Annex 2 to the Waste Act of 14 December 2012 (Journal of Laws 2023, item. 1587), to which the waste collected from the Contracting Authority will be subjected, together with an indication of the name and address of the installation/plant to which the waste will be sent, with the proviso that in the case of waste management in the process of disposal, this waste should be transferred to a municipal installation in accordance with Art. 1 of the Act of 14 December 2012 on waste. 7) Waste transport should be carried out in accordance with the requirements set out in the Regulation of the Minister of the Environment of 7 October 2016 on detailed requirements for the transport of waste (Journal of Laws No. Journal of Laws 2016, item 1742). 8) The waste will be transferred in bulk. 9) Each collection of waste will be carried out by weighing the collected waste on the legalized weight of the Ordering Party, located in RZUOK in Machnacz 41a, which will be confirmed by a weight certificate. This document will be the basis for determining the amount of waste collected by the Contractor and the basis for settlement. 10) The Ordering Party will be obliged to issue waste transfer cards in the electronic waste database in which the entity transporting waste and the installation to which this waste will be transferred will be indicated. The entity receiving the waste will be obliged to confirm the above-mentioned cards each time. The cards will be issued in accordance with the provisions of the Waste Act of 14 December 2012 (Journal of Laws 2023, item 1587). 11) The collection of waste will take place successively on working days from Monday to Friday, from 7:00 to 20:00, after the Ordering Party has sent the collection order, but no later than within 3 working days (the response date will be a criterion for the evaluation of offers in accordance with Chapter XXI of the TMS) from the date of its notification by the Ordering Party. In the collection order referred to in the first sentence, the Ordering Party shall each time specify the amount of waste to be collected. It is possible to change the amount of waste to be collected provided that the amount of waste indicated in the order is collected within the period referred to in the first sentence. The orders referred to above will be made electronically to the Contractor's e-mail address. 12) The place of receipt of waste is: Regional Municipal Waste Treatment Plant in Machnacz 41a, Brześć Kujawski (Kuyavian-Pomeranian Voivodeship). 13) In order to ensure the continuity of the collection of waste that is the subject of the contract with RZUOK in Machnacz, Brześć Kujawski, the Contractor is obliged to start collection of waste within a maximum of 5 working days from the date of the contract. 14) The Ordering Party reserves the right to reduce to 60% the amount of waste referred to in point. 2) above. In such a situation, the Contractor shall not have the right to claim: - charges for the amount of waste not collected, - compensation for lost profits.
