1. The procedure for awarding the public contract in question is conducted on the basis of the provisions of the Public Procurement Law Act of 11 September 2019 (hereinafter ‘the PPL Act’) and the implementing provisions issued on the basis thereof, in particular the Regulation of the Minister for Development, Labour and Technology of 30 December 2020 on subjective means of proof and other documents or declarations that the contracting authority may request from the contractor (hereinafter ‘the MR Regulation’) under an open tendering procedure. 2. Pursuant to Article 139 of the Public Procurement Act, the Contracting Authority will first examine and evaluate the tenders, and then make a qualitative selection of the contractor whose tender was the highest rated, as regards the lack of grounds for exclusion and compliance with the conditions for participation in the procedure. 3. Pursuant to Article 257(1) of the Public Procurement Act, the Contracting Authority provides for the possibility of cancelling the procurement procedure if the public funds that the Contracting Authority intended to use to finance all or part of the contract are not awarded to it. 4. An economic operator shall be excluded from the procurement procedure on the basis of: - Article 7(1) 1 of the Act of 13 April 2022 on special arrangements for counteracting the support of aggression against Ukraine and for the protection of national security (Journal of Laws No. U. 2024, item 507 i.e.). - Article 5k para. Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine Urz. EU No L 229), as amended by Regulation (EC) No 2022/576 of 8 April 2022 (OJ Urz. EU No L 111/1 of 8.4.2022) and amended by Regulation No 2022/1269 of 21 July 2022 (OJEU.L.2022.193.1) Detailed information in this regard can be found in the procurement documents. 5. In accordance with Art. 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) Urz. Żelazna 59A, 00-848 Warsaw, REGON: 368302575, TIN: 527-282-56-16; b) contact with the Data Protection Officer at PGW WP is possible at the following e-mail address: iod@wody.gov.pl; c) Your personal data will be processed on the basis of Art. 1 lit. c GDPR for the purpose related to the public procurement procedure marked with the procedure number W.ROZ.2710.26.2025/ZZWŁ conducted on the basis of the Public Procurement Law Act of 11 September 2019; d) the recipients of your personal data will be persons or entities to whom the documentation of the procedure based on Article 18 and Article 74 of the Public Procurement Law Act of 11 September 2019 will be made available; e) Your personal data will be stored in accordance with Art. 1 of the Public Procurement Law Act of 11 September 2019, for a period of 4 years from the end of the calendar year in which the procurement procedure was completed, and if the duration of the contract exceeds 4 years, the storage period covers the entire duration of the contract; f) the obligation to provide your personal data directly concerning you is a statutory requirement set out in the provisions of the Public Procurement Law Act of 11 September 2019, related to participation in a public procurement procedure; the consequences of failure to provide certain data result from the Public Procurement Law Act of 11 September 2019; g) in relation to your personal data, decisions will not be taken in an automated manner, application to Article 22 of the GDPR. h) you have: - pursuant to Article 15 of the GDPR, the right to access your personal data; - pursuant to Article 16 of the GDPR, the right to rectify or supplement your personal data (the exercise of the right to rectify or supplement may not result in a change in the outcome of the public procurement procedure or change the provisions of the contract to the extent inconsistent with the provisions of the Public Procurement Law Act of 11 September 2019 and may not violate the integrity of the Protocol and its annexes); - pursuant to Article 18 of the GDPR, the right to request the controller to restrict the processing of personal data, subject to the cases referred to in Article 18 par. 2 GDPR (the right to restriction of processing does not apply in relation to storage, in order to protect the rights of another natural or legal person, or for important reasons of public interest of the European Union or a Member State); - the right to lodge a complaint with the President of the Office for Personal Data Protection if you consider that the processing of your personal data violates the provisions of the GDPR and) you are not entitled to: - in connection with Article 17 para. 3 lit. b, d or e GDPR the right to delete personal data; - the right to transfer personal data referred to in Article 20 of the GDPR; - pursuant to Art. 21 GDPR, the right to object to the processing of personal data, because the legal basis for the processing of your personal data is Art. 1 lit. c GDPR. 6.The Ordering Party does not require the Contractor to carry out an on-site inspection or check by the Contractor the documents necessary to perform the order available on-site at the Ordering Party.
