1.The subject of the order is delivery along with the installation of household appliances and electronics for boarding houses in Łomża as part of the first equipment and electric cookers for purchased residential premises in Olsztyn and Ostróda. 2. The proceedings are divided into two parts: part 1 - delivery with installation of household appliances and electronics to boarding houses in Łomża as part of the first equipment; part 2 - delivery with installation of electric cookers to purchased residential premises in Olsztyn and Ostróda. 3. The Contracting Authority will exclude an Excluded Contractor from the procedure for the award of the contract in question on the basis of the following grounds: a) Article 108 para. 1 of the Public Procurement Law, b) Art. 1 of the Act of 13 April 2022 on special solutions to counteract the support for aggression against Ukraine and to protect national security (Journal of Laws of 2024, item 507), hereinafter referred to as: Act on counteracting the support of aggression, c) Art. Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine Urz. EU No L 111, 8.4.2022, p. 1); 4.The Contracting Authority shall call upon the Contractors whose tenders have been the highest scored in each lot to submit, within a specified period, not shorter than 10 days from the date of the call, the following personal means of proof, valid as at the date of their submission, confirming the absence of grounds for exclusion: 1) Information from the National Criminal Register within the scope specified in Art. 1 points 1 and 2 of the Act, drawn up not earlier than 6 months before its submission; 2) Information from the National Criminal Register within the scope of Art. 1 point 4 of the Act concerning the absence of a final ruling prohibiting the application for a public contract as a criminal measure drawn up not earlier than 6 months before its submission; 3) Declaration of the Contractor, within the scope of Art. 1 point 5 of the Act on non-membership in the same capital group, within the meaning of the Act of 16 February 2007 on competition and consumer protection (Journal of Laws No. Journal of Laws 2024, item 594), with another Contractor who submitted a separate tender for a given part or a declaration of belonging to the same capital group together with documents or information confirming the preparation of the tender in the procedure independently of another Contractor belonging to the same capital group – Annex 4 to the SWZ; 4) Declaration by the Contractor on the up-to-dateness of the information contained in the declaration referred to in Article 125 para. 1 of the Act in so far as it relates to the grounds for exclusion referred to in Art. 1 points 3-6 of the Act – Annex 7 to the SWZ; 5) Declaration of the Contractor on the up-to-dateness of information regarding non-exclusion from proceedings pursuant to Art. 1 of Regulation 2022/576 and Art. 1 of the Act on counteracting support for aggression – Annex 8 to the SWZ. 5. Together with the offer, the Contractors will submit: Declaration by the Contractor that he is not subject to exclusion from the procedure and that he meets the conditions for participation in the procedure referred to in Art. 1 of the Public Procurement Law, in the form of the European Single Procurement Document ‘ESPD’ – the model declaration is attached as Annex 3 to the EMS; 2. Declaration concerning the grounds for exclusion under Article 5k para. 1 of Regulation 2022/576 and Art. 1 of the Act on counteracting support for aggression – the template is attached as Annex 6 to the SWZ. In the case of joint tenderers, a declaration signed by the persons authorised to represent them shall be submitted by each of the joint tenderers. 3) Power of attorney authorizing to sign the offer, if the offer is signed by a proxy; 4) Power of attorney to represent the contractors jointly applying for the contract in the procedure, if applicable; (5) Justification on trade secrets, if applicable.
