Description

1. The subject of the contract is the delivery of server, storage and network systems to the contracting authority's headquarters. The subject-matter of the contract includes the following two tasks: Task No 1 covers the supply of server systems and storage, their installation and configuration in accordance with the requirements specified by the contracting authority in Part IV of the FTZ. Task No 2 covers the supply of network systems, their installation and configuration in accordance with the requirements specified by the contracting authority in Part IV of the FTZ. 2. Detailed requirements concerning the subject-matter of the contract are an integral part of the description of the subject-matter of the contract and are included in Part IV of the FTZ. 3. The contractor is obliged to provide the contracting authority with a quality guarantee and is obliged to perform the services resulting from it. The warranty requirements are set out in Parts III and IV of the FTZ. 4. The delivered subject of the order must be brand new, unexposed at exhibitions, complete and technically efficient. ‘Factory new’ means the subject-matter of the contract originally packaged, not used before the date of delivery, excluding the use necessary to carry out the test of its correct operation after production. 5. The subject of the contract must be free from any physical and legal defects and claims of third parties. 6. The delivered subject of the contract must come from the distribution channel of the manufacturer not excluding distribution to the Polish market and ensuring the implementation of warranty rights. 7. The subject of the contract must be delivered to the contracting authority’s premises and all other activities described in the FTZ must be carried out. 8. The subject of the contract must be delivered to the ordering party together with instructions for use, controllers and any accompanying software necessary for the proper use of the subject of the contract (obtaining full functionality indicated in Part IV of the FTZ). The contracting authority will not be obliged to pay any additional fees, in particular royalties, and any licenses will be granted as part of the contractor's remuneration, without any time and territorial limitation, unless otherwise expressly stated in Part IV of the FTZ. If licenses, codes or other permissions are needed to run and use this software, they must be provided at no additional charge. Codes, licenses and other permissions must also be provided when they are necessary to run or configure hardware components. It is not necessary to provide instructions for use, drivers and any accompanying software if it is possible to download them from the relevant services; in this case, however, the contractor is obliged to provide the passwords, codes, etc. necessary to collect them. 9. The supplied subject of the contract for mains power supply must be equipped with an adequate number of power cables to connect it to standard power outlets, unless otherwise specified in Part IV of the FVC. 10. After the installation and configuration of the delivered infrastructure, the contractor is obliged to make as-built documentation; the documentation should be provided in an electronic version on a medium or made available electronically (or other agreed with the contracting authority). The documentation shall contain at least the following elements: location of devices, package names and versions of installed factory (firmware) and system (operating systems) and application (file system) software, number of licenses delivered, type and duration of warranty for delivered software and hardware components, parameters related to the configuration of software and servers such as passwords, certificates, network settings, configuration settings specific to the software. The as-built documentation must be approved by the contracting authority as to its completeness and correctness. 11. The scope of the contract also includes conducting instruction for persons designated by the contracting authority, including the operation of devices, configuration and maintenance of the delivered software and infrastructure. The duration of the instruction must be sufficient to familiarize the participants of the instruction with the operation of devices and software. The instruction must be carried out within the time allowed for installation or acceptance activities. The instruction must be in Polish or English. 12. The Contractor and all persons performing the subject of the contract are obliged to comply with the regulations in force on the premises of the contracting authority. Failure to comply with the above will result in the need to leave the contractor and all persons performing the subject of the contract from the contracting authority's premises.
