Description

The contract shall include:
1. The scope of the works and project work is defined in Chapter III of the Terms of Reference ‘Functional and Use Programme’ and in the Specifications of the Relevant Contract Terms and Conditions.
1.1. The contracting authority assumes the optimisation of the design solutions contained in the Functional and Use Programme, in compliance with the applicable legal provisions and the principles of technical knowledge.
The contracting authority shall introduce the following guidelines for the optimisation of the design solutions contained in the Functional-Use Programme:
(1) Optimising the design solutions in the PFU must not be at the expense of the Contracting Authority, e.g. in the context of regulating the road lane, i.e. with regard to the area of land necessary for the acquisition (width of the road lane and demarcation lines) – the planned road should contain only the land strictly necessary for the planned road. The scope and solutions for optimisation must be agreed positively with the Contracting Authority at the stage of drafting the project documentation.
2) the functional-use design solutions adopted in the Functional and Use Programme should be considered as preliminary.
The surface structure shall be adopted with parameters corresponding to KR 4.
The design should be based on the results of the 2010 General Measurement of the Movement and the resulting traffic growth rates.
(3) Enhanced road ditches should be designed and carried out, only where necessary, in accordance with specific provisions including PN-S-02204:1997 Roads – dehydration of roads.
4) There is no obligation to carry out two-level crossings and business trips within the framework of the project.
5) No additional roadways – ‘servic’ roads should be designed and constructed throughout the entire section of the road. The transport operations of the parcels adjacent to the provincial road should be carried out primarily by means of exits. Exits must be carried out, inter alia, on each plot of land where, as a result of the construction or reconstruction of a road, a property adjacent to its road has lost access to a public road. Within built-up areas, exits with a hard surface (bituminous, paving) shall be carried out within the boundaries of the road lane (up to the entrance gates). On the other hand, in unbuilt land, in the case of exits to fields, the surface of exits must be designed and constructed with unenriched hard (aggregates) in the case of the design of new exits or reconversion of exits from ground surfaces or aggregates. Design technical solutions for exits, including types of pavement, should be agreed with the Contracting Authority.
At the same time, the Contracting Authority authorises the construction of access roads (servic) to ensure access to parcels adjacent to the road in cases where technically justified, e.g. high embankment and deep copies, as well as in the case of high density of small-width plots. The contractor will invent the existing exits. Existing exits will be reconstructed if this is due to the need to adapt them to adopted design solutions or poor technical condition. The remaining exits will not be rebuilt.
6) The drawings of the situational design documentation (construction design, implementation design) for road sections in built-up areas should be drawn up on a scale of 1:500
7) Acoustic protection (screens, replacement of window joinery or quiet surface) should be adopted on the basis of a new traffic forecast.
8) The Contractor will include in the design documentation the construction of a technological channel with minimum technical characteristics: 4 RHDPE 40/3.7 tubes with high compression strength.
9) With regard to the construction of the Oleszyce perimeter road:
— from km ~31+ 380 to km ~31+ 554 (according to the figure of the situational plan 1.23) and from km ~32+ 000 to km ~32+ 382 (according to the drawing of the situational plan 1.24), no additional carriageway – ‘servial’ road should be designed and constructed. The handling of parcels adjacent to the perimeter road shall be carried out in accordance with the principles set out in point 5.
(10) The cross-section of the bridge object M-3 at km 31+ 804,50 shall be designed and constructed as shown in Figure. 3.5 (overall figure M-3) with the following modifications:
— on the left side of the carriageway, in place of the footpath for pedestrians, a service pavement shall be designed and constructed in accordance with specific provisions;
— on the right side of the road in place of the pavement and the cycle path, a pedestrian pavement must be designed and constructed in accordance with specific provisions.
11) With regard to the construction of the Cieszanów road:
— the beginning of the scope of the construction of the perimeter road should be located at the intersection of provincial road No 865 with district road No 1655R at km ~43+ 998 (Figure 1.34),
— the junction must be designed and carried out in the form of a roundabout or as a junction channelled with additional lanes, in particular to turn left on the existing DW 865 carriageway from the Olešice side. The choice of intersection type and its geometry must be positively agreed with the Contracting Authority at the stage of drafting documentation,
— following the change in the scope of the investment, resolve the way of dewatering the road. The method of drainage adopted is intended to enable the investment to function independently as intended;
— from km ~45+ 217 to km ~45+ 270 (according to the drawing of the situational plan 1.35), no additional carriageway – the ‘servial’ road should be designed and constructed. The handling of parcels adjacent to the perimeter road shall be carried out in accordance with the principles set out in point 5.
(12) The contracting authority sets out below the list of demolition materials which are owned by the Contracting Authority:
— the whole of the asphalt destructure from the demolition of bituminous surfaces, which the Contractor transports to the PZDW material database in the foxes of the Lubaczów Voivodeship District in agreement with the Head of the Provincial Roads District in Lubaczów. Delivery and unloading costs shall be borne by the Contractor.
Other demolition materials shall be the property of the Contractor. The Contractor will reduce its tender price by the value of the demolition materials. Materials which cannot be re-built by the Contractor shall be disposed of or will manage themselves. The contractor will manage waste in accordance with the Waste Act of 14.12.2012 (as amended).
(13) The solution adopted in the Functional-Use Programme for horizontal marking as a thick layer should be considered as preliminary. It is noted that the Contracting Authority requires the Contractor to provide a guarantee for the horizontal markings carried out in full, i.e. at least 5 years.
14) The Contractor shall clear the road from the tree and remove all trees that will conflict with the construction of the road. Trees from felling are the property of the Contracting Authority. In the tender, the contractor will value the costs of delivery and unloading of the material database in the foxes of the lime.
(15) The Contractor shall, as far as possible, make use of existing road signs to implement the permanent traffic organisation project.

3. Provision of guarantees and warranties for defects in the performance of the contract for a minimum period of 5 years.
4. The contracting authority shall require that the design documentation and the works covered by the contract be carried out on the basis of and in accordance with:
4.1. Contract conditions for construction for electrical and mechanical equipment and engineering and construction works designed by the Contractor, General Conditions, 4th English-Polish Edition 2008, (translation of the first edition 1999), issued by:

4.2. Documents relating to the Regional Operational Programme for Podkarpackie Province 2014-2020;
4.3. The Specifications of the Relevant Contract Terms and Conditions including:
(a) Relevant provisions of the Agreement (Chapter V of the ToR);
(b) List of payments (Chapter IV of the ToR);
(C) Functional-Use Programme (Chapter III of the ToR);
(D) Instructions for economic operators (Chapter I of the ToR).
4.4. Timetable.
5. In particular, the contractor will be required to:
(a) fulfil the obligations arising from the Act of the Agreement, the ToR and the applicable legal provisions.
(b) elaborating the technical and formal legal documentation on the basis of which the construction work will be carried out.
(C) Design at the stage of drawing up the construction project, in accordance with the Regulation of the Minister for Infrastructure and Development (regarding service roads) of 17.2.2015 amending the Regulation on the technical conditions to be met by public roads and their location (Journal of Laws 2015, item 329).
(D) Achievement of a ZRID decision subject to immediate enforceability.
(e) execution of the works in accordance with the decision of the ZRID, the Act of the Contract, the ToR, the ToR, the applicable law and the conditions laid down in other administrative decisions.
(F) the inventory of land covered by the ZRID decision prior to the start of the construction works.
(g) Restoration of immovable property seized for the purposes of carrying out an investment to a proper condition enabling the property to be used for its intended purpose.
(H) Renewal and stabilisation by border signs of the points of breakdown of the boundaries of the road lane after completion of the implementation and protocol of handing over to the Contracting Authority.
(I) the protection of geodesic points and, in the event of destruction, their restoration.
(J) Ensure respect for the legitimate interests of third parties in the area of impact of the site.
(K) Construction site insurance in accordance with the terms of the Contract.
(L) incurring the costs of temporarily seizing plots of land necessary for the performance of the task. The contractor will determine with the landowners the form and extent of the temporary occupation of the plots of land.
(m) carrying out by-passes, crossings, commuting to premises, agricultural land/cultivated areas, land used adjacent to the investment for the duration of the works.
(N) identifying the locations of existing media such as sewerage, telephone and electric lines and poles, water supply network, gas pipes and others prior to excavation or other works.
(o) getting all necessary arrangements with local authorities, companies or owners for the removal and re-installation of existing media.
(p) Introduction of information and souvenir plaques in accordance with the Guidelines of the Managing Authority of the Regional Operational Programme for Podkarpackie Province 2014-2020 for beneficiaries with regard to information and publicity, and to comply with these guidelines.
(Q) Execution of an inventory of access roads (which will be used to transport materials for construction) and construction works (buildings, fences, etc.) located in the area of impact of the ongoing section of provincial road No 865. The inventory must be carried out before the start of the construction work. The inventory of access roads should be agreed with the relevant road manager.
(R) Exercise an inventory of all existing exits.
(s) transport to the Material Database of the PZDW in the foxes of the Lubaczów Voivodeship District has been agreed with the Head of the Regional Roads District in Lubaczów, as well as trees from felling owned by the Contracting Authority. A handover report must be drawn up to the Contracting Authority. Delivery and unloading costs shall be borne by the Contractor.
(T) the provision of permanent archaeological surveillance in the course of earthworks.
(U) checks prior to the commencement of studies and works on the site with regard to the presence of any unexplosive/exploded ordnance and, if necessary, secure saper surveillance.
6. The Contractor will be liable for all damage to road surfaces, drainage ditches, stands, pipelines, electrical cables, networks or media of all kinds caused by him or its subcontractors in carrying out the works. The Contractor must, without delay, at his own expense, make good any damage and, if necessary, carry out further repair works ordered by the Engineer.
7. The area necessary for the implementation of the project (which will be sent to the Contractor with a handover report for the construction site) for the duration of the project will be maintained by the Contractor. From the transfer of the construction site to the issue of the takeover certificate. The contractor will carry out summer and winter maintenance of the road section. Winter maintenance of road 865 shall be carried out in accordance with standard IV and instructions adopted in 2014/2015. The ‘principles of snow and slipping on provincial roads’ set out in Annex x to the PFU. The summer maintenance of the road will consist of mowing grasses. Grass mowing must be carried out three times a year, on the dates specified by the Contracting Authority.
8. Pavement design solutions adopted in the Functional and Use Programme should be considered as preliminary. It is the Contractor’s responsibility to draw up the design documentation in accordance with the applicable law and standards and to agree with the Contracting Authority on the design of the pavement structure in accordance with point 1. 2).
9. In the technical and construction project under development, a technological channel with 4 RHDPE 40/3.7 high compression performance tubes should be designed and constructed along the road. The duct shall be connected to the existing telecommunications infrastructure. The construction of the channel is intended to enable the future expansion of the SSPW network as well as to meet the needs of last mile operators.
10. Traffic organisation.
The contractor will draw up and obtain all the necessary opinions and approval of the provisional traffic organisation project. The contractor must inform the traffic authority, the road management and the Provincial Police Headquarters of the date of introduction of the organisation of traffic for the duration of the works (approved by the traffic authority) within a seven-day advance date. The above-mentioned advance notice concerns any change in traffic patterns for the duration of the works and the introduction of a permanent traffic organisation.
In addition to drawing up the required traffic organisation designs at its own expense, the contractor must:
— the removal of the time marking of works after completion,
— removal from the crown of road machinery and equipment during work breaks or security in a manner acceptable to the Supervision (Inspector),
— informing residents and persons carrying out economic, service activities, the Police, the State Fire Service, the Rescue Service, road transport operators including passenger transport, emergency staff, Marshal’s Office of Podkarpackie Province, Podkarpackie Regional Roads Administration in Rzeszów, local media, web portals, etc. in the area of works of expected traffic difficulties by providing information in a publicly accessible manner (e.g. notice boards, websites, gathering residents in the municipality, parishes, media outlets or other usual means) together with documentation of such action,
— cooperation with other entities for the non-colliatory performance of works in the occupied roadway,
— provide for work to be carried out on a multi-shift basis and on public holidays in order to reduce the duration of obstructions,
— ensure that approved traffic organisation projects are carried out within the period of validity, at the same time as maintaining and supervising the compliance of the traffic organisation with the approved design and the completeness and legibility of the marking.
The contractor will develop and obtain approval and implement the project of the Permanent Movement Organisation for the investment.
The design of the permanent traffic organisation shall include vertical and horizontal markings and traffic safety devices in the area affected by the object, taking into account the link to the applicable design.
The preparation shall include the required arrangements, opinions and approval of the traffic unit.
The project should be carried out in 4 copies on the basis of the Regulation of the Minister for Infrastructure of 23.9.2003 on detailed conditions for traffic management on roads and supervision of road traffic (Journal of Laws 2003/177, item 1729 as amended). The approved traffic organisation project shall be accompanied by letters sent to the traffic authority, the road management board and the Provincial Police Headquarters on the date of implementation of the traffic organisation, in order to determine whether these notifications were made within the time limit laid down in Section 12. 1 above.
