Description of the subject of the contract: a) The subject of the contract is a construction work consisting in the reconstruction of the ‘Bagatela’ junction and the road-track system on the section from the Bagatela Theatre to ul. Garbarska with accompanying infrastructure as part of the investment project entitled: Reconstruction of the tram track in ul. Straszewski and ul. Karmelicka together with the nodes and associated infrastructure in Krakow. (b) The Contracting Authority described the subject of the contract by means of the following annexes: - Draft provisions of the contract (PPU), constituting Annex No 2 to the FTZ, - Technical specifications for the execution and acceptance of construction works (STWiORB) constituting Annex No 6 to the FTZ, - Design documentation constituting Annex No 7 to the FTZ, - Measurement of works constituting Annex No 8 to the FTZ. (c) The Contracting Authority informs that the subject of the contract is co-financed from EU funds within the framework of: The project entitled "Reconstruction of the tram track in ul. Straszewski and ul. Karmelicka together with turnout nodes and accompanying infrastructure in Krakow" co-financed by the EU under the measure FENX.03.01 Urban transport European Funds for Infrastructure, Climate and Environment 2021-2027. (d) Required guarantee period: The minimum warranty period is 36 months. The maximum warranty period is 60 months. Tenders with a warranty period of less than 36 months will be rejected. (e) Where manufacturer names, trademarks, standards, approvals, technical specifications and reference systems appear in any annex to the FTZ, the products may be replaced by equivalent ones. The Employer will consider as equivalent solutions such solutions that allow to obtain the effect assumed by the Employer using other technical solutions. The Contracting Authority informs that whenever the design documentation and technical specifications for the execution and acceptance of construction works indicate the origin (brand, trademark, manufacturer, supplier) of the materials or indicate standards, approvals, technical specifications or reference systems referred to in Article 101 of the Public Procurement Law, the Contracting Authority allows the offering of materials or solutions that are ‘equivalent’ in terms of technical, functional and operational parameters, provided that they guarantee the execution of the works in accordance with the construction permit issued and ensure that technical parameters are not inferior to those assumed in this FTZ, and through their functionality the use of the Subject of the Contract will be achieved to no less than using the solutions used in the project by the Contractor. 280 days from the date of conclusion of the contract. g) The Ordering Party, in accordance with Art. 1 of the Public Procurement Act, requires the employment by the Contractor or Subcontractor on the basis of an employment relationship, of persons performing the following activities, with the exception of persons performing the so-called independent technical functions in construction within the meaning of the Construction Law Act: - lower technical staff (organisation and execution of construction works), - manual staff (direct execution of construction works).
