Description

The subject-matter of the contract is divided into 18 lots, hereinafter referred to as ‘packages’, each of which is the subject of a separate procedure. The breakdown into Packages and the total maximum size of all types of services in a package are as follows:
— Package 1 – provision of forest management services in the Zielonczyn Forestry:
• total labour intensity (number hours – ‘nh’ and clock hours – ‘h’) nh + h 4983,87;
• the total weight of wood to be harvested in sawn and pre-specific cuttings m³ 8857;
• the total weight of wood intended for scraping in wood and pre-particular cuttings m³ 8857;
— Package 2 – provision of forest management services in the Dzisna Forestry:
• total labour intensity (number hours – ‘nh’ and clock hours – ‘h’) nh + h 7602,08;
• the total weight of wood to be harvested in sawn and pre-chiplined cuttings m³ 4896;

— Package 14 – provision of nursery forest management services on a nursery farm in Krępsk, chemical plant protection in the Goleniów Forest District and transport of plants from nursery to forestry:

— Package 15 – provision of harvesting and scraping services using specialised machinery in forestry areas: Zielonczyn, Borowik, Krokorzyce, Widzisko and Stepnica:

• the total weight of wood intended to be taken to cut wood and pre-chipping m³ 11735;
— Package 16 – provision of harvesting and scraping services using specialised machinery in forestry areas: Wierzchosław, Krępsko, Goleniów:
• total mass of wood intended for machine harvesting in sawn and pre-chiplined cuttings m³ 13811;
• the total weight of wood intended to be taken to cut wood and pre-chipping m³ 13811;
— Package 17 – provision of harvesting and scraping services using specialised machinery in forestry areas: Dzisna, Inviso, Mosts:
• total weight of wood intended for machine harvesting in sawing and pre-chipping m³ 3403
• the total weight of wood intended for scraping in wood and pre-particular cuttings m³ 3403;
— Package 18 – provision of a service for harvesting cones from lying trees, fruits and seeds of forest trees and bushes for the nursery farm in Krępsk:
• total kilograms of cones, fruits and seeds kg 3666.
The contractor will be obliged to perform the subject-matter of the contract in accordance with the applicable law and the rules in force in the State Forest Management of the State Forests, and in particular in accordance with:
(1) the Regulation of the Minister for the Environment of 24.8.2006 on health and safety at work when carrying out certain forest management activities (Journal Journal of Laws No 161, item 1141 as amended);
(2) the Regulation of the Minister for the Environment of 22.3.2006 on detailed rules for the prevention of forest fires (Journal Journal of Laws 2006, No 58, item 405 as amended);
(3) The forest fire protection instruction, introduced by Order No 54 of the Director-General of State Forests of 21 November 2011;
(3) Instructions on health and safety at work when carrying out basic forest management work, introduced by Order No 36 of the Director-General of State Forests of 20.4.2012;
(4) the Forest Protection Instruction, introduced by Order No 57 of the Director-General of State Forests of 22 November 2011;
(5) Forest farming rules introduced by Order No 53 of the Director-General of State Forests of 21.11.2011;
(7) Fire Control Act of 24.8.1991 (consolidated text: Journal of Laws 2009, No 178, item 1380 late as amended);
(8) Polish Standard PN-D-95000:2002 Woodwood. Measurement of size and grading and other technical standards and conditions applied (as appropriate) during the production of wood raw material. At the stage of performance of the contract, the contracting authority reserves the right to:
(1) reduction in size, in the event of circumstances justified by the economic interest of the Contracting Authority, and in the event of other compelling reasons, in particular: natural causes, changes in demand and cyclical conditions in the timber market, circumstances caused by natural and natural disasters;
(2) change in the location of the performance of individual works – in the event of circumstances justified by the economic interest of the Contracting Authority;
(3) changes in the percentage share (up to 30 % compared to planned) of the different groups of wood sorting (WSM) and type of wood – per item and within a given lot (package).
The above-mentioned reduction in the size of the works, the change in location, the percentage change in the proportion of individual wood sorts and the type and species of wood in relation to the scope specified in these tender specifications does not constitute an amendment to the contract or the failure or improper performance of the obligations, and therefore does not give rise to any claim against the Contracting Authority.
During the performance of the contract, the following principles will be applied, as set out in the Catalogue of Working Time Standards for Forest Works:
(1) The Contracting Authority reserves the possibility of amending the parameters affecting the labour-intensiveness standard to the actual conditions prevailing at the time of performance of the work – only works accounted for in PLN/nh:
(a) the planned degrees of difficulty to all tables, by increasing or decreasing them;
(b) concerning supplements to working time standards (which are applied upon reasoned request and approved by the Forestry) to all tables, by increasing or reducing them.
(2) The value of forest work is the product of the units planned to be carried out (ha, ar, m³, m3p and others), the unit labour intensity (hours/ha, hour/m³, hour/m³, hour/m3p, 10:00 p.m., etc.) and the settlement rate adopted as a result of the tender, expressed in PLN per standard hour (PLN/nh).
(3) For Packages Nos 1-13 and 15-17, harvesting and scraping will be accounted for at rates in PLN/m³ – at separate rates for felling and felling.
(4) For package No 18 (seed harvesting), the settlement will be made in PLN/kg at species-specific prices – in accordance with the tender.
(5) Calculation for the mineralisation of fire lanes around tourist structures will be carried out on the basis of a catalogue of working time standards for forestry works (in PLN/nh), without taking into account any journey times, journeys, etc.
(6) In the absence of applicable unit standards, the selected work will be accounted for on the basis of actual working time, i.e. PLN/hour. (activities specified in the annexes, as GODZ RH, GODZ CH, GODZ CI, GODZ CP, GODZ CZ, possibly other).
Since the Contracting Authority is subject to a certification process in accordance with the standards laid down by the FSC (Forest Stewardship Council) and the PEFC Council, it requires contractors to apply the principles described in the study entitled: ‘Rules, Criteria and Indicators for Good Forest Management in Poland’ to the extent provided for operators carrying out forestry work and described in the study entitled “Polish criteria for forest certification”.
One Contractor may submit a tender for any number of packages. The bid for a given package must include all the items (work) making up the package.
Based on Art. 29 par. The Contracting Authority requires that persons carrying out the following activities during the performance of the contract be employed under an employment contract by the contractor or subcontractor:
(1) 1 person performing care activities – early cleaning and late cleaning, for packages from 1 to 12;
(2) 2 persons carrying out logging activities (tree felling and sorting) – for packages 1 to 7 and 9 to 13 and 1 person for package 8.
The contracting authority shall, in relation to the contracts referred to in packages 1 to 18, provide for the possibility of awarding complementary contracts as referred to in Article 67. 1 point 6 of the PPL, not exceeding 50 % of the value of the basic contract calculated separately for each of the packages.
