The contracting authority requires the employment by the contractor or subcontractor on the basis of an employment contract of persons performing activities in the field of contract performance: a) performing inspections b) performing repairs and maintenance 17. In connection with the determination by the Employer of the requirements referred to in Art. 1 of the PZP Act, the Contractor is obliged to perform the contract in the scope of performing the activities specified in point 16(a)-(b) of the SWZ, throughout the duration of the contract, by persons employed by the Contractor on the basis of an employment relationship in accordance with Article 22 §1 of the Labour Code. 18. The Contractor shall be required to submit a declaration on the number of persons referred to in point 17 on the date of conclusion of the contract in duplicate, in accordance with the model declaration contained in the FTZ. The Contractor is obliged to submit to the Ordering Party, each time at the request of the Ordering Party, within the time limit specified in the request, the following documents in order to confirm that the Contractor meets the requirements for the employment of employees on the basis of an employment contract: 1) a statement by the persons referred to in point 18 of the FTZ confirming the performance of the activities referred to in the Ordering Party's request as part of employment by the Contractor on the basis of an employment relationship; 2) the Contractor's statement on the employment on the basis of the employment contract of persons performing the activities covered by the Ordering Party's request. That statement shall include, in particular: precise identification of the entity submitting the declaration, the date of submission of the declaration, an indication that the activities covered by the request are performed by persons employed on the basis of an employment contract, the number of such persons, the type of employment contract and the length of time worked, and the signature of the person authorised to submit the declaration on behalf of the Contractor; 3) copies of employment contracts of persons performing activities covered by the declaration referred to in point. 19 containing: the name of the employee employed, the date of conclusion of the employment contract, the type of employment contract and the scope of duties of the employee; 4) certificate of the competent branch of ZUS, confirming the payment by the Contractor of social and health insurance contributions for employment on the basis of employment contracts of persons referred to in point. 19 for the last accounting period, 5) a copy of the proof confirming the declaration of employees referred to in point. 18 for social security. 20. If the Ordering Party becomes aware that the Contractor does not meet the requirements set out in Art. 1 of the PZP Act, the Ordering Party has the right to withdraw from the contract, in accordance with § 12 sec. 4 of the contract, for reasons for which the Contractor is responsible. 21. The Ordering Party informs that in accordance with Art. 1 of the Act of 26 June 1974 on the Civil Code, by establishing an employment relationship, the employee undertakes to perform work of a certain type for and under the direction of the employer and at a place and time determined by the employer, and the employer undertakes to employ the employee for remuneration. This type of employment is employment on the basis of an employment relationship, regardless of the name of the contract concluded by the two parties. 22. The Employer requires that the contractor in the tender declare that the activities specified by the Employer in accordance with Art. 1 of the Public Procurement Act will entrust persons employed on the basis of an employment contract by the contractor.
