Description

1. The subject of the contract are successive deliveries by the Contractor to the Ordering Party of reagents, calibrators, control and consumable materials for performing haematology tests, hereinafter referred to as the goods, described in detail in the Price Form constituting Annex 2 to the CVT together with the lease of 2 (two) analyzers for determining blood morphology parameters (hereinafter referred to as interchangeable devices or the subject of lease), described in detail in the List of Required Functions and Technical Parameters constituting Annex 6 to the CVT and in accordance with the draft provisions of the contract constituting Annex 4 to this CVT. 2. In the absence of demand for the assortment covered by the subject of the contract, the Ordering Party reserves the right not to order a part of the assortment specified in Appendix No. 3. The Contractor shall not be entitled to any claim for damages or any claim based on any other legal basis, to which the Contractor agrees. 3. The Contracting Authority guarantees that the minimum value of contracts awarded to the Contractor during the term of the contract in the basic scope will be 50% of the maximum value of the Contractor's remuneration, specified in the price form constituting Annex No. 2 to the SWZ. The Contracting Authority informs that in the procedure conducted under the open tender procedure, it provides for the possibility of applying the procedure referred to in Article 139 para. 1 of the Public Procurement Act, the Contracting Authority, using the above-mentioned procedure, will first examine and evaluate the tenders, and then make a qualitative selection of the Contractor whose tender was the highest rated in terms of the lack of grounds for exclusion and compliance with the conditions for participation in the procedure.
