1. The subject of the contract is the supply of vegetables and fruits for the 31st Tactical Air Base. 2. The delivered goods should meet the requirements in accordance with the applicable provisions of food law, contained, among others, in the following legal acts: a) Act of 25 August 2006 on food safety and nutrition (Journal of Laws No. Journal of Laws 2023, item 1448, as amended), b) Act of 16 December 2005 on products of animal origin (Journal of Laws No. Journal of Laws 2023, item 872 as amended), (c) of the Act of 21 December 2000 on the commercial quality of agri-food products (Journal of Laws No. Journal of Laws 2022, item 1688, as amended), d) of the Act of 7 May 2009 on pre-packaged goods (Journal of Laws No. Journal of Laws 2022, item 2255), (e) Regulation (EC) No 178/2002 of the European Parliament and of the Council of 28 January 2002 laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety, (f) Regulation (EC) No 2073/2005 of the European Parliament and of the Council of 15 November 2005 on microbiological criteria for foodstuffs, (g) Commission Regulation (EC) 2023/915 on maximum levels of certain contaminants in food and repealing Regulation (EC) No 1881/2006, (h) Regulation (EC) No 852/2004 of the European Parliament and of the Council of 29 April 2004 on the hygiene of foodstuffs, (i) Regulation (EC) No 1935/2004 of the European Parliament and of the Council of 27 October 2004 on materials and articles intended to come into contact with food and repealing Directives 80/590/EEC and 89/109/EEC, (j) Regulation of the Minister of Agriculture and Rural Development of 23 December 2014 on the labelling of individual foodstuffs (Journal of Laws No. Journal of Laws 2015, item 29), k) Regulation of the Minister of Health of 22 November 2010 on permitted additional substances (Journal of Laws No. Journal of Laws 2010, No 232, item 1525 as amended), (l) Regulation (EC) No 1169/2011 of the European Parliament and of the Council of 25 October 2011 on the provision of food information to consumers. 3. The detailed description, the applicable documents and the quality requirements referred to in Article 246(2) of the PPL of the subject-matter of the contract are set out in Annex 1b – ‘Description of the subject-matter of the contract’ and Annex 4 to the SWZ – ‘Draft contract’. The scope of the contract is included in Appendix 1a to the SWZ - price form. The tender must be submitted, failing which it will be null and void, in electronic form. Under pain of nullity, the offer should be drawn up in Polish in electronic form, signed with a qualified electronic signature (within the meaning of Regulation (EU) No 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and trust services for electronic transactions in the internal market and repealing Directive 1999/93/EC) by a person/persons authorized to represent the Contractor in business transactions, in accordance with the registration act and statutory requirements or by a statutory representative. CONTENT OF THE OFFER: The tender must contain: 1. OFFER FORM – drawn up in accordance with the model attached as Annex 1 to the CVS. 2. PRICE FORM – drawn up in accordance with the model attached as Annex 1a to the CVT. Together with the tender, the contractor is obliged to submit: 1. AUTHORISATION OR OTHER DOCUMENT CONFIRMING AGREEMENT TO REPRESENT THE CONTRACTOR, if the contractor is acting on behalf of a person whose authority to represent him does not result from documents confirming the right to act in legal transactions.
