1. The subject of the contract is the supply of control and testing equipment, i.e.: PART 1 : 1.1. Chlorophyll fluorimeter – 1 set 1.2. Laboratory refrigerator – 1 item 1.3. Laboratory freezer – 1 item 1.4. Incubator – 1 piece PART 2 : 2.1 Lyophilizer - 1 piece 2.2 Electroporator - 1 piece PART 3 : 3.1. Multispectral drone – 1 set PART 4 : 4.1. Plate reader – 1 piece PART 5 : 5.1. UV-Vis spectrophotometer – 1 piece PART 6 : 6.1. Water bath – 1 piece 2. The Contractor is obliged to perform the contract on the terms and conditions described in the model contract constituting Annex 3 to the FTZ. 4. The Contractor shall be obliged to: - transport of the delivered equipment to the ordering building in the city of Kielce; - bringing and setting up the delivered equipment to the premises indicated by the contracting authority ; - the connection and commissioning of the supplied equipment, in order to demonstrate the correct operation; - provide training in accordance with the provisions of Annex 1; - providing warranty service during the warranty period at the place of use of the equipment, on the terms specified in the contract. 5. The delivered equipment must be brand new, without traces of use, must come from current production, i.e. it must be manufactured not earlier than 2025 and must not be subject to the rights of third parties. 7. The delivered equipment should have the required by law attestations, certificates, quality certificates and meet all the requirements of standards specified by applicable law, taking into account primarily its intended purpose. 8. The delivered equipment must have a warranty card, instructions for use (paper version) and all the necessary documents required for this type of equipment on the day of delivery; should be equipped with all the elements (connections, cables, etc.) necessary to run and work with the Ordering Party for the purpose for which they are purchased, without the need to purchase additional elements by the Ordering Party. 9. All documents attached to the delivered subject-matter of the contract must be drawn up in Polish in printed form (manual of use – preferred electronic version stored on a flash drive). 10. All documents must be drawn up in such a way as to ensure accessibility for persons with disabilities, in particular taking into account the principles arising from: 1) Act on the accessibility of websites and mobile applications of public entities (April 4, 2019, Journal of Laws 2019, item. 848, late. Journal of Laws 2023, item 511); 2) Act on Ensuring Access to Persons with Special Needs (of 19 July 2019, Journal of Laws No. Journal of Laws 2019, item 1696); 3) Accessibility standards for cohesion policy (Annex 2 to the Guidelines on the implementation of the principle of equal opportunities and non-discrimination, including accessibility for persons with disabilities and the principle of equal opportunities for women and men under EU funds); 4) Convention on the Rights of Persons with Disabilities (drawn up in New York in 2006, ratified by Poland in 2012, Poz. 1169).
