1. The subject of the contract is to perform the function of supervising inspector for the task entitled: Extension of the provincial road No. 540 on the section from km 6+435 to km 8+310 in the municipality of Stara Biała, Płock district, Voivodship No. Mazowieckie – Proceeding No 254/24. 2. A detailed description of the subject of the contract can be found in Part IV of the SWZ – General Terms and Conditions. 3. In the case of indicating in the description of the subject of the contract trademarks, patents or origin, source or a specific process that characterizes the product or services provided by a specific contractor, the Contracting Authority allows equivalent solutions. 4. Where reference is made in the description of the subject-matter of the contract to standards, European Technical Assessments, approvals, technical specifications and technical reference systems, the Contracting Authority shall allow solutions equivalent to those described. 5. The subject-matter of the contract has not been divided into lots. The contracting authority shall not allow partial tenders to be submitted. 6. The contracting authority provides for the award of contracts referred to in Art. 1 point 7 of the Public Procurement Act with a net value of PLN 527 204.89. With regard to similar services, the Contracting Authority provides for supervision over the following scope of works: - preparatory works, - earthworks, - foundations, - surfaces, - finishing works, - traffic safety devices, - street elements, - drainage of the road body, - construction of a culvert, - rainwater drainage, - water supply network, - gas network, - reconstruction and construction of lighting, - reconstruction and construction of power lines, - reconstruction of the telecommunications network, - construction of a technological channel. The above-mentioned supervision service concerns the section on which the construction works will be carried out and/or adjacent sections. 7. The Contractor is obliged to have up-to-date civil liability insurance (OC) for damage caused during the performance of the contract in the subject of the contract and to third parties for the entire duration of the contract and for a guarantee amount not lower than PLN 1 000 000.00 (in words: one million zlotys 00/100). The Contractor is obliged to provide a copy of the above-mentioned policy within 7 days from the date of conclusion of the contract. Provided that the continuity of insurance is maintained, the Ordering Party allows the possibility of presenting several policies confirming the possession of third party liability insurance during the term of the contract. The Contractor is obliged to provide the Ordering Party with a copy of the next policy within 7 days from the expiry date of the previous policy. If the Contractor fails to comply with the above, the Contracting Authority shall charge the Contractor contractual penalties in the amount specified in the contract. 8. Deadline for the execution of the contract: 76 months from the date of signature of the contract, including: Stage I: − up to 14 months from the date of signing the contract – period of supervision over construction works, − up to 16 months from the date of signing the contract – supervision during the period in which the Contractor of works is obliged to obtain a permit to use the facility. The duration of the contract may change in proportion to the duration of the construction works and obtaining a decision on the permit to use the facility. Phase II: − up to 60 months from the date of signing the acceptance protocol for the subject matter of the construction works contract – the period of supervision after the completion of the construction works. 9. The contractor whose tender has been selected as the most advantageous shall lodge a performance bond amounting to 5% of the total price quoted in the tender. Requirements concerning the performance guarantee are described in Chapter XX of Part I of the SWZ. 10. The contracting authority provides for the application of the so-called reverse procedure referred to in Art. 1 of the Public Procurement Act, i.e. The Contracting Authority will first examine and evaluate the tenders and then select the Contractor whose tender has received the highest score in terms of the lack of grounds for exclusion and fulfilment of the conditions for participation in the procedure. 11.
