Note: The Ordering Party requires the placement of brand new baskets, which at the end of the contract become the property of the Ordering Party. 2.The subject of the order has been divided into 2 Parts, i.e.: 1)Part I of the contract – concerning the setting and emptying of street baskets in the city of Kalisz in sector 2 – the characteristics of the sector are set out in an annex to the SWZ entitled: ‘Summary of streets in sector 2 and in the ‘Schedule for emptying street baskets set up in the city of Kalisz in sector 2’, (2)Part II of the contract — concerning the setting and emptying of street baskets in the city of Kalisz in sector 3 — the characteristics of the sector are set out in an annex to the LMS entitled: ‘List of streets in sector 3 and in the ‘Timetable for emptying street baskets set in the city of Kalisz in sector 3’. 3.The detailed scope of work and frequency of the service are specified in the annexes to the SWZ, i.e. schedules drawn up for each part, the draft contract (competent with regard to Parts I - II) and the annex to the SWZ entitled: Description of the subject of the contract (OPZ) Standards of contract performance: ‘Setting and emptying baskets in the city of Kalisz in sectors 2 and 3 in 2025 and 2026’, which define the quality standards for the performance of the service, the expectations of the Ordering Party, contractual penalties and the conditions for determining the correctness of the performance of the service. 4.The service will be carried out in accordance with the schedules (including the list of locations and frequency of service provision) constituting annexes to this SWZ: (a)Part I-number of street baskets set is 349 pcs, giving 65,854 emptyings (including 200 emergency emptyings); (b)Part II – the number of street baskets set is 267, giving 46 325 emptyings (including 200 emergency emptyings); - according to the net unit price for setting and emptying in PLN given in the Offer Form. Environmental Protection Law, the Act of 14 December 2012 on waste, the Act of 13 September 1996 on maintaining cleanliness in municipalities and the implementing provisions for these acts. 7.Whenever in the SWZ and its annexes the subject matter of the contract is described by reference to standards, European Technical Assessments, approvals, technical specifications and technical reference systems referred to in Art. 1 point 2 and paragraph. 3, it shall be presumed that equivalent arrangements to those described are permitted and that such reference shall be accompanied by the words ‘or equivalent’. 8.Whenever the subject-matter of the contract is described in the SWZ and its annexes with an indication of trade marks, proper names, patents or the origin of the source or specific process, such indications shall be deemed to be accompanied by the words ‘or equivalent’. 9.The order for all Parts will be executed on the following dates: 1) The start of the contract will take place on 01.04.2025 and the completion of the contract will take place on 31.12.2026 or on the day on which the amount indicated in §5 sec. 3 contracts – whichever occurs first. 2) The term of the contract may change in the cases described below, in particular if the contracting authority exercises the right of option.
