Description

The different titles of the task mentioned in the project documentation, STWIBOR and the sub-measurement relate to the same task, i.e. the execution of small-scale retention facilities in the Village/previous Comoros/Forestry Forestry Syców.
1. The detailed description of the subject-matter of the contract shall include:
(1) Project documentation – Annex 7 to the ToR
(2) Technical specifications for the implementation and acceptance of construction works – Annex 8 to the ToR
(3) Letters, Decisions and Administrative (ancillary) provisions – Annex 9 to the ToR.
2. General requirements for works:
(1) All materials and equipment necessary for the performance of the task shall be provided by the Contractor. All materials used for the performance of the subject-matter of the contract must have the technical and qualitative characteristics set out in the STWIORB and must be accompanied by appropriate attestations and certificates.
(2) If the technical documentation contains names of specific products, devices or a term suggesting specific products, the Contractor shall consider that examples of products have been given and the Contracting Authority allows the use of products, products, equivalent materials with characteristics, technical parameters not lower than those specified in the design documentation.
3. During the execution of the works, the Contractor shall, within the limits of the bid price, be required to:
(1) facilities in a place agreed with the Contracting Authority, protection of the area covered by the works, including bystanders’ access,
(2) absolute compliance with Decision No WPN.670.11.2012.PK of 19 March 2012 of the Regional Directorate for Environmental Protection in Wrocław laying down the conditions for carrying out works during the construction of a retention reservoir (Annex 9 to the ToR).
(3) the maintenance of public traffic on the construction site during the duration of the task until the completion and final acceptance of the works. The Contractor will secure the permanent conditions for the visibility of signs, at day and night, for which this is necessary for security reasons. All signs and other security devices will be accepted by the Contracting Authority.
(4) carrying out the works in accordance with the scope provided for in the design, the technical specifications for the execution and acceptance of the works, the applicable standards and regulations and the principles of construction works,
(5) performance of the subject-matter of the contract, using its own materials, in accordance with the contract, technical knowledge and legal provisions,
(6) perform demolition and construction works in accordance with the requirements of the Regulation of the Minister for Infrastructure of 6.2.2003 on health and safety at work during construction works (Journal of Laws Journal of Laws No 47, item 401, as amended),
(7) the handling of waste generated during the performance of the contract in accordance with the Waste Act of 27 April 2001 (i.e. 2010, No 185, item 1243 as amended) and the Act of 27.4.2001 Environmental Protection Law (i.e.: OJ Journal of Laws 2008, No 25, item 150, as amended),
(8) use of construction materials and equipment having:
— safety mark certificates,
— technical approvals,
— certificates of conformity or declarations of conformity,
— attestations.
(9) the protocol takeover of the construction site,
(10) organise, develop and secure the construction site with due diligence, including the maintenance of order on the site;
(11) the protection of property located on the construction site,
(12) remedy immediately any damage or breakdown caused by the Contractor during the execution of the works,
(13) the interruption of works at the request of the contracting authority and, consequently, the guarantee that the works will be carried out before they are destroyed,
(14) secure the performance of the works in such a way as to ensure the safety of the users of the facility.
(15) respect for the legitimate interests of third parties present in the sphere of influence of the site.
(16) drawing up and forwarding to the Contracting Authority the as-built documentation and notification of the subject-matter of the contract for final acceptance,
(17) completion of all necessary tests, acceptances and tests with satisfactory results before the subject of the contract is notified,
(18) clean-up of the land after the works have been completed and handed over to the Contracting Authority no later than the final date for acceptance of the works,
(19) participate in take-back operations, remedying the defects found, handing over the required attestations and certificates,
(20) notification in writing of availability for final acceptance fifteen (15) days before the end of the warranty period and warranty for defects.

5. Supplementary information
All materials and equipment necessary for the performance of the task shall be provided by the Contractor. All materials used for the performance of the subject-matter of the contract must have at least the technical and quality characteristics set out in the STWIORB and must be accompanied by appropriate attestations and certificates.
6. Note:
(1) The price is flat rate and must cover all the works resulting from the design documentation and the technical specifications for the execution and acceptance of the works, bills of measurement (auxiliary printing).
(2) Before entering the unit prices under each item, the Contractor should consult the relevant tender documents. Letters, decisions and administrative orders are supporting material.
(3) If some of the works shown in the project documentation submitted to the contractor are not included in the pre-measurements and their execution is necessary, the costs of these works should be included by the contractor in the prices entered under the existing headings of the tender estimate.
(4) In particular, in the prices indicated for each item in the estimate, the contractor must take account of the need to carry out, assemble and dismantle the works and to carry out other ancillary works on the site which are necessary for the execution of the works in accordance with technical knowledge and construction.
