Description

The subject of the contract is the granting of rights to use MICROSOFT software products on a subscription basis. The products subject to the contract are described in Annex 3-Price Offer and in Table 1 of the technical specification, part of the documentation. The Contracting Authority reserves the right to change the quantities of licences applied for for each calendar year for which the respective licences are activated. The maximum period within which the Contractor shall grant the Assignor access to the licences by e-mail through the contact persons of both parties shall be 10 (ten) working days from the date of commencement of the contract period. For the second and third years of the contract, the Assignor shall send an order to the Contractor with the respective number of licenses within 15 (fifteen) days before the expiry of the licenses of the previous year. The Contractor is obliged after receiving the order from the Assignor to renew the licenses before their expiry. Within the same period described above, the Contractor shall provide the Assignor with a document issued by the manufacturer certifying the validity of the licenses by type and volume under this section for the benefit of the Assignor. For the document submitted under the terms of the contract under the preceding article, the parties to the contract shall sign an acceptance-delivery protocol without objections to the validity of the licences for a period of one year. In the event of non-compliance of the licences granted, they shall be recorded in a statement of findings drawn up for that purpose, and the contracting authority’s monitoring officer shall set a deadline for the contractor to replace the non-compliant licences with licences that comply with the requirements of this contract. The Contractor undertakes: To provide up-to-date versions of the products. To provide patches to solve specific problems. To provide service – from Monday to Friday from 8:00 to 16:30, with response time in case of problems - 4 hours. The Contractor undertakes, after receiving a request from the Assignor by e-mail, telephone, or system for registration of incidents and problems, to confirm in writing (by e-mail, system for registration of incidents and problems) that the request has been accepted and to launch a procedure (start the implementation of the necessary activities) in order to remedy the problem. To provide technical advice/assistance in Bulgarian by phone, e-mail or on site. Provide on-site technical intervention to solve technical problems if necessary. To assist in problem solving or escalation of problems to be solved by the manufacturer. To provide within three days (from the date of signing the contract) access to the official website of the manufacturer. The access rights must allow for the consultation of the status of all Microsoft products and related services used by the Assignor, as well as the receipt of updates and new versions of the products. In the event that, at any time during the term of the Contract, production of a product according to a price scale covered by the contract ceases and at the same time that product ceases to be marketed, the product concerned should be replaced by a product with equivalent or better characteristics, with a price not higher than the price of the product which has ceased to be produced. The parties undertake to notify the other party within 7 working days of the change in the contact persons, as well as the e-mail addresses through which the performance of the contract will be served. The Contractor shall notify the Assignor within one week if, during the term of the contract, he loses his authorisation from the manufacturer.
