Equivalent arrangements and criteria for assessing equivalence: 1) The Ordering Party shall consider as equivalent to the specified solution a solution with the same purpose, technical, quality and functional characteristics corresponding to the technical, quality and functional characteristics indicated in the description of the subject of the contract, or better, marked with another trademark, patent or origin. 2) The equivalent solution must allow the fulfilment of the objective assumed by the Ordering Party through performance and functional parameters affecting the effectiveness of the operation, the same or better than the indicated minimum requirements. 3) The use of the names of solutions, materials and devices in the description of the subject of the contract serves to determine the minimum standard of performance and determine the characteristics and technical requirements assumed in the technical documentation for the designed solutions. 4) The Contractor is obliged to demonstrate that the equivalent solutions offered will meet the minimum requirements. 5) The absence of the term "minimum" means a minimum requirement and the Contractor can offer a solution with better parameters. (6) In order to preserve the principles of technological neutrality and competitiveness, solutions equivalent to those specified shall be accepted, whereby a solution which, in terms of technology, performance and functionality, does not deviate from or is better than the functional and performance technologies specified in the specified solution shall be deemed equivalent. 7) The features of the solution specific only to the specified solution are not subject to comparison, such as: proprietary patents, proprietary technological solutions, proprietary protocols, etc., but only those that constitute the essence of the whole assumed technological solutions and have a reference in the equivalent solution. Therefore, the Contractor may propose solutions that implement the same functionalities specified by the Ordering Party in a different way than specified. 8) Very similar (similar) value in use is understood as similar, with the admission of slight differences not affecting in any way the entire system, behavior and implementation of similar functionalities in given conditions, for which these solutions are dedicated. The equivalent solution must contain documentation confirming that it meets the functional requirements of the Ordering Party, including the results of comparisons, tests or possibilities offered by this solution in relation to the specified solution. 9) In addition, wherever the origin (brand, trademark, manufacturer, supplier, etc.) of materials or standards, approvals, specifications and systems referred to in the Public Procurement Law Act , has been indicated, the Employer allows offering the subject of the contract or equivalent solutions, provided that they ensure obtaining technical parameters identical or better than those required by the Employer in the tender documentation. The contracting authority shall allow equivalent materials or equipment to be offered. When describing the subject of the contract using specific standards, approvals or technical specifications and reference systems, the contracting authority allows solutions equivalent to those described. The Contractor, who refers to solutions equivalent to those described by the Ordering Party, is obliged to demonstrate that the supplies offered by him meet the requirements specified by the Ordering Party. In such a situation, the Ordering Party requires the submission of appropriate documents substantiating these solutions. 4. The rules for carrying out the supply in question are set out in the ‘Draft Contract’, which is attached as Annex 8 to the FTZ.
