A detailed description of the subject of the contract, the scope and conditions of performance of the contract are described in the draft provisions of the Agreement with attachments, constituting Annex No. 1 to the SWZ, including: 1) description of the subject of the contract (hereinafter: OPZ), constituting Annex No. 2 to the Agreement and in the model for the valuation of the service, constituting Annex No. 3 to the SWZ. 3. The contracting authority shall require an offer to be submitted after the contractor has carried out an on-site inspection. The required on-site visit consists of two parts: 1) getting acquainted with the type and technical condition of bicycles (used equipment) in the ZDMiKP warehouse, at ul. Witebska 5 in Bydgoszcz, in two dates to choose from: - term 1: 11.12.2024, 11:00 – 12:00, - deadline 2: 12.12.2024, 11:00 – 12:00, 2) getting acquainted with the construction and technical solutions of existing bicycle stations, on the example of a bicycle station located in Bydgoszcz, at ul. Kaliskiego / University of Technology, in two dates to choose from: - term 1: 11.12.2024, 12:30 – 13:30, - Deadline 2: 12.12.2024, 12:30 – 13:30, All bike stations covered by the contract have the same technical solutions and operate in the same way. The Contractor may, in addition to the required vision of the sample station, independently make a vision of other selected stations. The route recommended by the Ordering Party between the warehouse and the location of the sample bicycle station is given in Annex 4.2 to the SWZ (map). The required on-site visit will take place in the presence of the Contracting Authority Representative, who will draw up two attendance lists for the participants, respectively, for each of the two parts of the visit. The document of power of attorney of the persons representing the Contractor to participate in the vision should be handed over to the Representative of the Contracting Authority. During the vision, the Purchaser will not answer the contractors' questions. Communication of contractors with the Ordering Party takes place only in accordance with the principles described in Chapter VIII of the SWZ. In addition, a declaration by the Contractor that an on-site inspection has been carried out will be required in addition to the tender (the model declaration is attached as Annex 4.1 to the SWZ). The declaration shall be submitted by at least one of the economic operators jointly applying for the contract. Failure to participate in the on-site visit described above disqualifies the Contractor and will result in the rejection of the offer. 4.Customer, in accordance with Art. 1 PPL, requires the contractor or subcontractor to employ in the performance of the contract (during the entire duration of the contract) for an employment contract within the meaning of the provisions of the Labour Code (Article 22 § 1), persons performing during the performance of the contract: 1) relocation of bicycles and activities to ensure an appropriate number of bicycles at stations, 2) maintenance, repair, service of bicycles and stations, 3) operation of the "Contact Centre" A detailed description of the requirements of the Ordering Party in this respect is provided in the draft provisions of the contract, which are Annex 1 to the EMS. 5.The Contractor may entrust the performance of part of the contract to a subcontractor, taking into account the prohibition described in point V.11. SWZ. As far as subcontracting is concerned, the provisions of Articles 462-465 of the Public Procurement Law shall apply. The Contractor must indicate in the Tender and in the ESPD the proportion (in % or material scope) of the contract which he intends to subcontract and, if known, the names of any subcontractors. The absence of a declaration by the contractor in this respect will mean that the contractor intends to carry out the entire contract on its own. The Contractor shall be liable for the actions, omissions and negligence of the subcontractor as for his own actions. 6. The contracting authority does not provide for the award of contracts referred to in Art. 1 point 7 of the PPL. 7. The contracting authority shall not allow partial tenders to be submitted. The contracting authority shall not divide the contract into lots. Justification for not dividing the contract into lots: From an economic, operational and technical point of view, it is justified to award the service to one entity and not to divide the contract into lots, because: 1) division into lots would probably increase the cost of the task, as each of the Contractors would have to perform the same tasks, e.g. launch a mobile application, website, Contact Centre and IT system, etc., 2) division into lots would create problems for users, as they would probably have to use different applications, websites, Contact Centre, etc. The lack of division into lots does not limit access to the contract for economic operators from the sector of small and medium-sized enterprises (SMEs).
