1. The subject of the contract is the successive supply of foodstuffs for the J. Kusociński Primary School No 1 in Ożarów Mazowiecki in the assortment and quantities (subject to point 4.3 of the SWZ) given in Annex No 1 to the SWZ. 2. The quantities of deliveries indicated in the above-mentioned annex are estimated requirements for a maximum period of 12 months (parts A, B, C, D, E, F) from the date on which the contract is signed, provided that the term of the contract ends on 31 August 2025 (suspension of deliveries during the holiday months: July or August 2025 – school break – to be determined during the implementation of the contract). 4. The scope of the subject of the contract may change, i.e. : a) Quantities of products in individual parts are estimated and may be reduced (up to 30%). They will be used only to compare offers and choose the most advantageous offer, i.e. that they do not constitute the final size of the order, as a result of which they cannot constitute grounds for making claims for unrealized deliveries or grounds for refusing deliveries. The Ordering Party will not bear negative financial consequences caused by a decrease in the quantity and value of supplies. The Ordering Party reserves the right to change the quantity of deliveries between items in the subject of the contract. b) The Ordering Party also allows the possibility of increasing the ordered quantities of individual products specified in Appendix No. 1 to the SWZ. In connection with the above, the Contracting Authority, referring to the provision of Art. 1 of the Act provides for the possibility of applying the right of option. In the event that, during the performance of the contract, it turns out that the Employer's demand for the supply of food products, not included in Annex No. 1 to the SWZ, will increase, the possibility of exercising the option and increasing the supply at the flat-rate gross unit prices specified by the Contractor in his offer is reserved. The delivery covered by the option right may not exceed 30% of the total gross offer value of the subject of the contract. 5. The Ordering Party allows the prices of products included in the Contractor's offer to be indexed during the performance of the contract, in accordance with the provisions contained in the contract. 6.Change in prices as a result of indexation requires a written form under pain of nullity.
