Description

1. The subject of the contract is the service entitled ‘Renovation and review of the Polish Register of Shipping icebreaker ‘NARWAL’ in order to issue a class certificate and a safety document to the Inland Navigation Office in Bydgoszcz’. The detailed description of the subject-matter of the contract and the conditions for the performance of the contract shall specify: Description of the subject-matter of the contract – Annex 1 to the FTZ and Draft provisions of the contract – Annex 8 to the FTZ. 2.The Ordering Party shall not allow the submission of partial tenders. The contracting authority does not divide the contract into lots for the reasons set out in the OPZ – Annex 1 to the FTZ. In addition, the contracting authority awards a contract for the provision of services in lots, each of which is the subject of a separate procedure, and this contract is one of those separate lots. 3.The Contracting Authority does not provide for the possibility of awarding contracts referred to in Art. 1 point 7 of the PPL Act. 4.The Ordering Party does not reserve the obligation for the Contractor to personally perform the key parts of the contract. The contracting authority allows the participation of subcontractors in the performance of the contract. In the case of participation of subcontractors in the performance of the contract, the Contracting Authority, in accordance with Art. 2 of the Public Procurement Act, requires the Contractor to indicate in the tender the parts of the contract which it intends to entrust to subcontractors and to provide by the Contractor the names of subcontractor companies, if they are already known. Entrusting the performance of part of the contract to subcontractors does not release the Contractor from responsibility for the proper performance of the contract. Subcontracting requirements are set out in the PPU. 5.The Ordering Party does not provide for the possibility of exercising the right of option referred to in Article 441 of the Public Procurement Act. 6.Ordering Party, in accordance with Art. 1 of the Public Procurement Act requires the Contractor to employ, on the basis of an employment relationship, persons, hereinafter referred to as ‘Employees’, who, during the performance of the contract, will perform the activities specified by the Contracting Authority in the OPZ and in the PPU. The Contracting Authority does not require the Contractor to employ the persons referred to in Art. 2 point 2 of the PPL Act. 7. The contracting authority shall not require: on-site inspection by the Contractor or verification by the Contractor of the documents necessary for the performance of the contract available on the spot from the Contracting Authority. The Contracting Authority recommends that the Contractor carry out a local survey of the place of performance of the works in order to obtain the information that may be necessary for the preparation of the tender and for the conclusion of the contract and the performance of the contract. An on-site inspection is not a necessary condition for the submission of a tender in the present proceedings. The Contracting Authority shall not cover the costs of travel to the site of the on-site visit or the costs of providing security measures used by the Contractors. The contracting authority informs that the estimated value of the basic contract is PLN 149 980.00 net. 9. The contracting authority does not require a security to be lodged in the proceedings in question. 10. The contracting authority requires the provision of a security for the proper performance of the contract in the proceedings in question. Before signing the contract, the Contractor shall be required to lodge a performance bond for an amount representing 5 % of the total gross price indicated in the tender. The security may be lodged in one or more of the following forms: - money; - bank guarantees or guarantees of a cooperative savings and credit union, except that the obligation of the credit union is always a monetary obligation; - bank guarantees; - insurance guarantees; - guarantees provided by entities referred to in Art. 5 point 2 of the Act of 9 November 2000 on the establishment of the Polish Agency for Enterprise Development. The details of the performance guarantee are set out in point 16 of the FTZ. 11. All costs related to participation in the procedure, in particular the preparation and submission of a tender, shall be borne by the Contractor submitting the tender. The contracting authority does not provide for reimbursement of the costs of participation in the procedure. 12. BZP Proceedings Plan No: 2025/BZP 00112251/13/P; Item of the plan: 2.3.72. 13. The contracting authority reserves the right to cancel these proceedings on the basis of Article 257 of the Public Procurement Act if the funds it intended to allocate to the performance of the contract are not granted to it in whole or in part. The contracting authority is entitled to cancel the procedure for the above-mentioned condition at any stage of the procedure and in respect of selected parts of the contract. The contracting authority retains the right to cancel the procedure on the above-mentioned condition both when it receives unequivocal information about not granting it funds for the performance of the contract, and in the event of delay in obtaining them in relation to the assumed date of performance of the task, if the lack of funds in time prevents the performance of the contract. The Contractor does not have the right to request the Contracting Authority to take action to obtain funds for the performance of the contract, if these will not be granted to him from the assumed source. In the event of annulment of the procedure pursuant to Article 257 of the Public Procurement Act, the Contractors shall not be entitled to reimbursement of any costs of participation in the procedure, including, in particular, reimbursement of the costs of carrying out an on-site inspection, the costs of calculating and preparing the tender and, by participating in the procedure on the terms set out in these documents, the Contractors shall accept without reservation.
