The public contract in question is implemented by a negotiated procedure with publication and conclusion of the contract in accordance with Article 45 of the ZJN-3 by publication on the public procurement portal and in the Official Journal of the European Union as follows: • Phase 1 of the procedure - assessment of the tenderer's capacity per lot, or, depending on the information provided for qualitative selection required by the contracting authority/entity, the tenderer meets the requirements of the contracting authority/entity and submits the application for each lot. In the first stage of the procedure, the contracting authority will, on the basis of the documentation received, recognise the capacity of tenderers for each lot whose applications will be admissible. The contracting authority will publish the capacities of the tenderers in the "Decision on the Recognition of Competences" on the Public Procurement Portal. • Phase 2 of the procedure - Submitting a tender for each lot and conducting negotiations with tenderers and submitting a final tender. The contracting authority reserves the right to invite tenderers to submit samples (each individual item for all lots). In addition to the required evidence, the technical suitability of the goods offered will be determined on the basis of the submitted samples of tenderers at the request of the contracting authority!
