Description

At the time of publication of the European call for tenders "Framework contract for the supply of decompression needles and 2 types of valve pneumothorax", 4 invalid tenders were submitted. See link Mercell: https://s2c.mercell.com/today/97626. As a result, the contracting authority cannot/may not lawfully award the framework agreement. It can also be concluded that the Contracting Authority could not have foreseen that four invalid tenders would be submitted in the present European open procedure. This will only be different if there are intentional errors on the part of the Ministry of Defence, which is not the case in the present tendering procedure. For the Contracting Authority, the possibilities to shorten the time limits of the open procedure, the restricted procedure and the negotiated procedure with prior publication (see Articles 2.71 to 2.74 of the Procurement Act) are not sufficient to meet the direct demand for these products for the operation of the Contracting Authority. The Contracting Authority therefore invokes the exception of extreme urgency (Article 2.32(1)(c) of the Aanbestedingswet) to conclude a framework agreement for a maximum period of 6 months.
