Description

1. The subject of the contract are successive deliveries by the Contractor of meat and cold cuts and poultry and poultry products in quantities and assortments described in detail in terms of type, quality and quantity in the price form constituting Annex 2 to the FTZ (hereinafter referred to as the goods), in accordance with the draft provisions of the contract constituting Annex 4 to this FTZ. 2. In the absence of demand for the goods covered by the contract in the quantity specified in the price form constituting Annex 2 to the FTZ, the Ordering Party reserves the right not to order a part of it, subject to sec. 3. The Contractor shall not be entitled to any claim for compensation or any claim based on any other legal basis, to which the Contractor agrees. 3. The Contracting Authority guarantees that the minimum value of contracts awarded to the Contractor during the term of the contract for a given task will be 70% of the value of that task specified in the price form constituting Annex 1 to the contract. The Contracting Authority informs that in the procedure in question, conducted under the open tender procedure, it provides for the possibility of using the procedure referred to in Article 139 sec. 1 of the Public Procurement Act, using the above procedure, the Contracting Authority will first examine and evaluate the tenders, and then make a qualitative selection of the Contractor whose tender was the highest rated in terms of the lack of grounds for exclusion and compliance with the conditions for participation in the procedure.
