IV. The subject of the contract for the task entitled: ‘Receipt and management of waste from stops and public places in the Podegrodzie commune in 20252025’ – contract consisting in the repetition of the same type of contract. 1) The subject of the contract includes: a) collection of waste from stops and public places (street baskets located on roads), covering a total of 116 points (an estimated 25 Mg of waste per year) and transport of this waste to management sites. The subject-matter of the contract concerns waste with the code: 20 03 03 - waste from cleaning streets and squares, 20 03 01 - unsegregated (mixed) municipal waste, 15 01 06 - mixed packaging waste. (b) cleaning and emptying of street baskets located on roads, squares and transport stops, as well as cleaning up the site at the waste collection point, (c) each time cleaning up the site at the waste collection point in the above-mentioned 116 points. The scope of collection of waste from stops includes cleaning the shed and the place without the shed, the pavement along the entire length of the bay, and in the absence of a bay on the length of 3 m on each side of the information sign. The scope of collection of waste from public places includes cleaning the surface of the pavement or shoulder at a length of 3 meters on each side of the basket. d) cleaning of stops and public places will take place at least twice a week in the period from the beginning of May to the end of September and once a week in the remaining period, in accordance with the current Regulations for maintaining cleanliness and order in the Podegrodzie Commune, and its possible subsequent amendments. e) baskets at stops and in public places are containers with a capacity of 50 l. The list of stops and public places is attached as Annex 5.1 to the invitation to negotiate. A detailed description of the subject of the contract is attached as Annex 5, 5.1 to the invitation to negotiate. 2) In addition, as part of the contract, the Contractor is obliged to perform all the works necessary for the performance of the contract for Lot II, among others: a) maintaining cleanliness at the place of performance of the service, b) securing work in terms of health and safety, c) covering damage caused during the performance of the contract, also towards third parties, d) marking of vehicles performing services in accordance with the provisions in this regard. (3) Requirements for employment on the basis of an employment relationship, in the circumstances referred to in Article 95: In accordance with the provisions of Article 95 para. 1 of the Public Procurement Act, the Contracting Authority requires employment on the basis of an employment contract by a contractor or subcontractor, of persons performing the following works:  operation of vehicles, machinery and equipment necessary for the performance of the Lot II contract. (excluding persons who independently perform a given activity as part of a sole proprietorship, the so-called. ‘self-employment’ or operating in the form of a civil law partnership or partnership and the activity will be carried out by persons who are partners in that partnership). 4) During the performance of the contract, the contracting authority is entitled to perform control activities against the contractor regarding compliance by the contractor or subcontractor with the requirement of employment under the employment contract of persons performing the activities indicated in point 3. The Ordering Party is entitled in particular to: a) request statements and documents confirming compliance with the above-mentioned requirements and assessing them, b) request explanations in case of doubts regarding the confirmation of compliance with the above-mentioned requirements, c) carry out on-the-spot inspections of work. 5) During the performance of the contract, at each request of the contracting authority within the period specified in that request, the contractor shall submit to the contracting authority the following evidence in order to confirm compliance with the employment requirement under the employment contract by the contractor or subcontractor of persons performing the activities indicated in point 3) during the performance of the contract: • declaration of the contractor or subcontractor on employment under the employment contract of persons performing the activities to which the contracting authority's request relates. The declaration shall contain in particular: a precise identification of the entity submitting the declaration, the date of submission of the declaration, an indication that the requested activities are carried out by persons employed under an employment contract, together with an indication of the number of those persons, the names of those persons, the type of employment contract and the size of the post, and the signature of the person authorised to submit the declaration on behalf of the contractor or subcontractor; • a certified true copy of the contract/contracts of employment of persons performing, during the performance of the contract, the activities covered by the above-mentioned declaration of the contractor or subcontractor (together with the document regulating the scope of duties, if it has been drawn up), as appropriate by the contractor or subcontractor. A copy of the contract/contracts should be anonymized in a way that ensures the protection of employees' personal data, in accordance with the provisions of the Act of 29 August 1997 on the protection of personal data (i.e. in particular without addresses, PESEL number of employees). The name of the employee is not anonymized. Information such as: the date of conclusion of the contract, the type of contract of employment and the duration of the post should be identifiable; • a certificate from the competent ZUS branch confirming that the contractor or subcontractor has paid social and health insurance contributions for employment on the basis of employment contracts for the last settlement period; • certified as a true copy of the original by the contractor or subcontractor, respectively, a copy of the proof confirming the employee's registration by the employer for insurance, anonymized in a way that ensures the protection of employees' personal data, in accordance with the provisions of the Act of 29 August 1997 on the protection of personal data.
