There are objective circumstances that justify a state of urgency within the meaning of Article 74(4) of the Public Procurement Act and require a shortening of the time limit for receipt of tenders under this open procedure. The financing of the subject matter of the contract became effective only on 14 May 2026. At the same time, the deadline for actual delivery, acceptance, invoices and full reporting to the financing authority was fixed at 30 June 2026. The period between the approval of the funds (14 May 2026) and the deadline for reporting (30 June 2026) was less than two months. The conduct of an open procedure with standard legal deadlines for the receipt of tenders, combined with the technological time for the examination of tenders, the conclusion of a contract and the actual time for production and delivery by the contractor, makes it objectively impossible to implement the project within the requirements of the funding authority. Non-compliance with the deadline (30.06.2026) carries a direct risk of losing funding of EUR 142,738.74 excluding VAT. This, in turn, will lead to the impossibility of commissioning the built infrastructure for social services and will deprive end users of access to residential care and an accessible environment. In view of the above, there is an urgency resulting from external, objectively imposed funding periods, which is not the result of the slowness of the contracting authority. This urgency makes it necessary to shorten the time limit for receiving offers to the minimum allowed by law, in order to ensure the effective spending of funds and the timely launch of social services.
