Description

1) The subject of the contract are forest management services as defined in Art. 1 point 1 of the Forests Act of 28 September 1991 (consolidated text: Journal of Laws Journal of Laws 2023, item 1356 – ‘Forests Act’), covering work on forest breeding and protection, fire protection, logging and harvesting of wood and nature protection, tourist management, maintenance of forest roads and fire access, and forest nursery and seed production, to be carried out in the Jarocin Forest District in 2026. 3.1. The material scope of the subject-matter of the contract 2) The material scope of the subject-matter of the contract includes the aggregated amounts of works in the field of forest breeding and protection, fire protection, logging and harvesting of wood and nature protection, tourist management, maintenance of forest roads and fire accesses, as well as nursery and forest seed production resulting from Annex 2 to the FTZ, which consists of: Annex 2.1. – the planned size of the work; Annex 2.2.1. - the detailed size of the work by groups of activities, activities and location; Annex 2.2.2. - valuation of the value of the contract for individual works; Annex 2.3.1. – forestry logging characteristics; Annex 2.3.2. – Forest harvesting sorting system; Annex 2.3.3. a statement of the distances and conditions of the harvesting of the timber; Annex 2.3.4. – a list of items with additional difficulties in obtaining and leaching; Annex 2.3.5. – a list of items not made available for machine acquisition; Annex 2.3.6. – information on optimal harvesting technology (potential); Annex 2.3.7. - information on the optimal harvesting option; Annex 2.4.1. - potential locations for the care of forest crops; (3) The material ranges set out in the annexes included in Annex 2 are indicative. 4) Quality standards relating to all the essential characteristics of the subject-matter of the contract are set out in Annex 3 to the FTZ, which consists of: Annex 3.1. ‘Description of standard technology for the execution of forestry works’ Annex 3.2. Tables of Parameters (separately for each of the Packages) concerning the activities indicated in the ‘Description of the standard of technology for the execution of forestry works’ Annex No 3.3. ‘Description of the technology standard for the execution of nursery management works’ Annex 3.4. Tables of Parameters (separately for each of the Packages) concerning the activities indicated in the ‘Description of the standard of technology for the performance of works in the field of nursery management’ Annex No 3.5. ‘Description of the fire protection technology standard’ Annex 3.6. Table of Parameters (separately for each of the Packages) concerning the activities indicated in the ‘Description of the fire protection work performance technology standard’ Detailed description of the technology standard for the execution of individual forestry works (activities) set out in Annex No 3.1 to the FTZ and in Annex No 3.3 to the FTZ detailed description of the technology standard for the execution of works in the field of nursery management (activities) and in Annex No 3.5 to the FTZ detailed description of the technology standard for the execution of fire protection works constitute the basis for determining the quality requirements relating to the elements making up the subject-matter of the contract (Annex No 2 to the FTZ). If the activity described in the above-mentioned annexes is not provided for in the description of the subject of the contract (Annex No 2 to the FTZ), the provisions of Annex No 3.1 to the FTZ or Annex No 3.3 to the FTZ or Annex No 3.5 to the FTZ shall not apply in this respect. The Parameter Tables contain (separately for each Package) detailed information on how to carry out certain activities described in Annex No. 3.1. to the FTZ Description of the standard of technology for the execution of forest works or in Annex No. 3.3. to the FTZ Description of the standard of technology for the execution of works in the field of nursery management or in Annex No. 3.5. to the FTZ a detailed description of the standard of technology for the execution of fire protection works, in specific conditions regarding a given Package included in the subject of the contract. 5) Descriptions of the codes of activities describing individual forest works (activities) included in the subject of the contract are described in Annex 3 to the FTZ. 6) The description of the rules of the procedure for the acceptance of forestry works is contained in Annex 3 to the FTZ. 7) The subject-matter of the contract has been divided into lots (the ‘Package’) 8) The performance of the works included in the subject-matter of the contract for individual Packages will take place in the area of forestry – specific to the given Package (the ‘Package Implementation Area’). The location (forest address) of individual forest works falling within the scope of the Agreement, as indicated in the Annexes included in Annex 2, is preliminary. The location (forest address) of individual works falling within the scope of the Agreement shall be specified in the Order referred to in point 3.3.(1) with the proviso that it will always be the Package Implementation Area. 9) The provisions of points 7 to 9 shall not prejudice the Employer's rights under the model public procurement contract (Annex No 12 to the FTZ, Annex No 12a to the FTZ). 10) In the case of mandatory exclusion of the position from harvesting in the machine system (harvesting of wood at cutting positions where the use of multi-operational machines is unacceptable) in particularly justified cases, e.g. changes in the conditions for which the above activities have been established, the Ordering Party allows a change in the technology of harvesting wood.
