The subject of the contract is: collection and management of waste of code 17 09 04 (mixed construction, repair and dismantling waste other than those mentioned in 17 09 01, 17 09 02 and 17 09 03) originating from Municipal Selective Waste Collection Points and waste collection services provided by economic operators and natural persons. Construction waste is collected at the Ordering Party in bulk in an unroofed box on a hardened ground. The Ordering Party will load these wastes into a set of containers with a capacity of 36 m3 (average load weight 14 Mg) previously substituted by the Contractor or on a regular basis on bath-type semi-trailers, movable floor, which will be resistant to possible damage related to the loading of heavy waste that may be in waste with code 17 09 04 - for this type of damage the Ordering Party will not be liable (average load weight on a movable floor 13 Mg). The Contractor's means of transport will have to be equipped with a tarpaulin or net to protect waste during transport. The offered waste management method with code 17 09 04 must comply with the applicable law and treatment processes specified in Annex 1 to the Act of 14 December 2012 on waste (Journal of Laws of 2023, item. 1587, as amended). The Contracting Authority shall entrust the Contractor with segregation from waste of code 17 09 04, at least: wood, metals, glass, plastics, plaster and mineral waste, including concrete, bricks, tiles and ceramics, and stones, to ensure their suitability for preparation for re-use, recycling or other recovery, unless separation is not technologically possible or the absence of separation allows preparation for re-use, recycling or other recovery. The Contracting Authority does not allow the Contractor to submit an offer only for waste collection. The contractor in the tender will have to provide the name and address of the installation together with the number of the place of business in the BDO and the symbol of the waste treatment process (in accordance with Annex 1 to the Act of 14 December 2012 on waste) to which the waste will be subjected. The contractor receiving waste of code 17 09 04 from the Contracting Authority is obliged to deliver it directly to the installation indicated in the tender. The waste with code 17 09 04 will consist of, among others, various types of plastics, paper and cardboard, wood, metal, glass, debris and, above all, various types of used building materials and interior fittings removed during renovations. The Contracting Authority will enable the Contractor to take samples of the waste in question in order to carry out its own research on quality parameters. The contracting authority also allows for an on-site inspection and a trial collection of waste code 17 09 04. The collection of waste with code 17 09 04 will take place from Monday to Friday from 600 to 1800, in quantities previously determined (by e-mail) by the Ordering Party with a representative of the Contractor. Weighing of waste collected by the Contractor will take place on legalized scales of the Ordering Party and will be confirmed by a weight certificate and a waste transfer card generated in the BDO system. These documents will form the basis for determining the amount of waste received with code 17 09 04 and issuing a VAT invoice. It is permissible to settle the service performed by the Contractor on the basis of the weight of waste indicated in the waste transfer card accepted by the installation accepting waste for management, only with the written consent of the Ordering Party. Documents related to the transfer of waste will be issued on the basis of legal requirements in this regard. The Contractor shall draw up and provide the Ordering Party with a written confirmation of submission of the received waste to the management process with the name, address and number of the place of business (BDO) in which the waste was finally managed, after the end of each calendar month in which its collection will take place and within 5 days after the last collection of waste. In addition, the Contractor will enable verification of the proper management of the received waste in accordance with the provisions of the Waste Act (in particular, those specified in the terms of the Contractor's administrative decision). The estimated quantity of waste code 17 09 04 to be transferred to the Contractor during the term of the contract will be: OK. 5 800,00 Mg. The Ordering Party reserves that the given quantity is an estimated value, illustrating the possible size of the scope of the subject of the contract. The detailed scope of the Contractor’s rights and obligations is governed by the Draft Contract (Annex 1 to the SWZ). Text automatically translated in your browsing language Automatically translated
