Description

1. The subject of the contract is the supply of sets of graphics stations and laptop computers. 2. As part of the Contract Subject, the Contractor shall in particular be obliged to: a) Delivery of 15 pieces of graphics stations (hereinafter referred to as the Equipment); b) Providing 2 pieces of portable computers such as a mobile graphics station (hereinafter referred to as the Equipment). 3. The equipment should be covered by a minimum 36-month warranty (according to the information provided by the Contractor in the offer - 36 months / 48 months / 60 months) calculated from the signing of the Equipment Acceptance Protocol – without comments. 4. The place of delivery of the Equipment is the building of the Marshal's Office of the Lublin Voivodeship at 4 Artur Grottgera Street in Lublin. The Contractor shall provide transport to the premises indicated. 5. The description of the subject of the contract is attached as Annex 1 to the SWZ. 6. If the procurement documents indicate, in respect of certain materials or equipment, trademarks, patents or origin - the Contracting Authority, in accordance with Art. 5 PPL, allows the offering of equivalent materials or devices. Materials or devices from specific manufacturers determine the minimum quality parameters, performance characteristics that must be met by materials or devices offered by the Contractor in order to meet the requirements set by the Ordering Party. Materials and equipment from specific manufacturers are only a quality standard of the subject of the contract. Whenever the contracting authority describes the subject-matter of the contract by reference to standards, European technical assessments, approvals, technical specifications and technical reference systems, it shall allow solutions equivalent to those described. 8. Whenever a specific label or certificate referred to in Articles 104 and 105 of the Public Procurement Law is used in the SWZ or procurement documents, the Contracting Authority shall also accept all other markings confirming that the works, supplies or services meet equivalent requirements. 9. In cases where the Contractor, for reasons beyond his control, is unable to obtain a label or certificate specified by the Contracting Authority confirming that the works, supplies or services offered by him meet equivalent requirements, the Contracting Authority shall, within a period specified by it, accept other means of proof, in particular technical documentation of the manufacturer, provided that the Contractor proves that the works, supplies or services offered by him meet the requirements of a specific label or specific requirements indicated by the Contracting Authority. 10. The use of a certificate issued by a conformity assessment body or a test report carried out by that body as a means of proof of compliance with the requirements or characteristics set out in the description of the subject-matter of the contract, the tender evaluation criteria or the contract performance conditions in the RTS or procurement documents means that the Contracting Authority also accepts certificates issued by other equivalent conformity assessment bodies. The Contracting Authority shall also accept other appropriate means of proof, in particular the technical documentation of the manufacturer, where the Contractor concerned has neither access to the certificates or test reports nor the possibility of obtaining them in good time, provided that such lack of access cannot be attributed to the Contractor concerned, and provided that the Contractor concerned proves that the works, supplies or services which he performs meet the requirements or criteria set out in the description of the subject-matter of the contract, the tender evaluation criteria or the contract performance conditions. 11. Describing the subject-matter of the contract by reference to the standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and sec. 3 PPL, the Ordering Party allows solutions equivalent to those described. 12. The contracting authority may not reject a tender on the sole ground that the supplies offered do not comply with the standards, technical assessments, technical specifications and technical reference systems to which the description of the subject-matter of the contract refers, provided that the Contractor proves in the tender, in particular by the means of proof referred to in Articles 104 to 107 of the Public Procurement Law, that the solutions proposed satisfy to an equivalent extent the requirements set out in the description of the subject-matter of the contract.
