The subject-matter of the contract is the expansion of the computing cluster for the AMU Artificial Intelligence Centre – the subject-matter of the contract has been divided into 3 lots. The subject of the contract is described in Annex A to the FTZ. Lot 1, 2, 3 - The order must be completed: up to 60 days from the date of conclusion of the contract and receipt by the Contractor of the confirmation of the competent authority supervising the Contracting Authority in accordance with Art. 14.1 in conjunction with Article 83(1)(26)(a) of the VAT Act of 11 March 2004 (Journal of Laws No. Journal of Laws 2024, item 361 as amended) or receiving information that it is not possible to issue such a confirmation by the competent authority supervising the Contracting Authority (the deadline for implementation is a criterion for the evaluation of tenders). The deadline for implementation is one of the criteria for the evaluation of tenders. The Contractor shall deliver the subject of the contract at his own expense and risk at the places specified by the Ordering Party. Domestic and foreign transport, including insurance, all customs duties, stamp duties and any other charges - on the part of the Contractor. The Contractor shall attach to the tender the evidence in question in the following form: technical description of the offered subject-matter of the contract, including all necessary information to assess the conformity of the tender with the description of the subject-matter of the contract – Annex A to the FTZ (i.e., in particular, catalogue sheets of the offered equipment, information folders, a summary containing the manufacturer and model of the offered equipment, configuration and parameters in Polish, etc.); The contracting authority envisages supplementing the evidence in question on the basis of Article 107(1)(b) CTMR. 2 of the Public Procurement Law; Minimum conditions of warranty and service - in accordance with SWZ. The contracting authority shall allow equivalent tenders to be submitted. The Contractor may offer equipment with the same or better technical, quality and functional parameters, meeting the minimum parameters specified by the Contracting Authority in Annex A to the FTZ. If the description of the subject of the contract includes trademarks, the Contractor may offer an equivalent assortment not worse than the assortment indicated by the Ordering Party. The equivalent assortment must meet the condition that it is at least of the same class, or with the same parameters expected by the Ordering Party, i.e. the equivalent assortment must meet or exceed the technical and operational requirements described by the Ordering Party in the SWZ. The Contractor who relies on solutions equivalent to those described by the Ordering Party shall be obliged to demonstrate that the equipment offered by him meets the requirements specified by the Ordering Party, in particular by the means of evidence in question, that the supplies offered meet the requirements, characteristics or criteria specified by the Ordering Party. The contracting authority shall accept the equivalent means of proof in question if it confirms that the supplies offered meet the requirements, characteristics or criteria specified by the contracting authority.
