Description

1. The subject of this contract is the performance of the service of collecting municipal waste from the owners of real estate residing in the municipality of Drzycim and from the point of separate collection of municipal waste, as well as their management. A detailed description of the subject of the contract is presented in a separate Annex No. 1 to the FTZ entitled: ‘Detailed description of the subject-matter of the contract’. 2. The service of collecting and managing municipal waste will be carried out in accordance with the applicable provisions of law, and in particular with the provisions of: - the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (i.e.: Journal of Laws Journal of Laws of 2025, item 733), - the Act of 14 December 2012 on waste (i.e. Journal of Laws Journal of Laws 2023, item 295 as amended), - the Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements for the collection of municipal waste from property owners (Journal of Laws No. Journal of Laws 2013, item 122), - Resolution No XLII/337/2023 of the Council of the Commune of Drzycim of 1 March 2023 adopting the ‘Regulations for maintaining cleanliness and order in the Commune of Drzycim’ (publication: Official Journal of the Kujawsko-Pomorskie Province of 6 March 2023, item 1678), - Resolution No XIX/109/2025 of the Drzycim Municipal Council of 4 August 2025 on the detailed manner and scope of the provision of services for the collection of municipal waste from property owners and the management of such waste, in exchange for a fee paid by the property owner for the management of municipal waste, in particular the frequency of the collection of municipal waste from the property owner and the method of providing services by separate collection points for municipal waste, (publication: Official Journal of the Kujawsko-Pomorskie Province of 8 August 2025, item 3733), - Regulation of the Minister of the Environment of 16 June 2009 on health and safety at work in the management of municipal waste (Journal of Laws No. Journal of Laws 2009/104, item 868), - Resolution No XXXII/545/17 of the Kujawsko-Pomorskie Provincial Assembly of 29 May 2017 on the implementation of the ‘Waste Management Plan for Kujawsko-Pomorskie Voivodship 2016-2022 with an outlook for 2023-2028’; At each stage of the performance of the contract, the contractor should monitor the applicable rules and, in accordance with them, implement the subject of the contract, in the event of a change in the relevant legal provisions, adapt the manner in which the service is performed to them.
