Description

1. The subject of the contract is the purchase of diesel buses in the amount of 2 pcs. for the needs of the Zawiercie Municipal Transport Department. 2. A detailed description of the subject-matter of the contract (OPZ) is contained in Annex 1a to the FTZ. 3. The scope of the contract covers the supply of the above-mentioned buses together with the equipment, necessary software, documentation and training under the conditions set out in these tender specifications. 4. Buses offered: a) The buses offered shall comply with the requirements and conditions laid down in Regulation No 107 of the Economic Commission for Europe of the United Nations (UNECE) - Uniform provisions concerning the approval of vehicles of category M2 or M3 with regard to their general construction [2015/922] (OJEU.L.2015.153.1 of 2015.06.18), hereinafter referred to as UNECE Regulation No 107. b) The buses offered shall be equipped with an internal combustion engine. c) The buses offered shall be made with the maximum use of non-combustible materials, in particular with regard to the materials used for the construction and interior fittings of the bodywork, and shall be EEC approved by the vehicle with regard to the flammability tests of elements of passenger compartment equipment and the driver's cabin made in accordance with Regulation No 107 of the Economic Commission for Europe of the United Nations (UNECEECE). d) The buses offered shall comply with the provisions laid down in Section III of the Act of 20 June 1997 - Road Traffic Law (Journal of 2024, item. 1251 as amended) and comply with the technical conditions laid down in the Regulation of the Minister for Infrastructure of 31 December 2002 on the technical conditions of vehicles and the scope of their necessary equipment (Journal of Laws 2024, item 502 as amended). (e) The buses offered should meet the requirements and conditions set out in the Regulation of the Minister of Infrastructure of 2 August 2023 on the type-approval of vehicles (Journal of Laws 2023.1651). (f) The buses offered should meet the standard PN-S-47010:1999 or equivalent for a city bus of class I or M. (g) The buses must meet the requirements set out in the Regulation of the Minister of Infrastructure of 31 December 2002 on the technical conditions of vehicles and the scope of their necessary equipment (Journal of Laws 2024, item 502 as amended). h) The bus type offered should have a valid Vehicle Type Approval Certificate or EC Vehicle Type Certificate of Conformity – within the meaning of the Road Traffic Act of 20 June 1997 (consolidated text: Journal of Laws 2024, item 1251, as amended), constituting the basis for its registration in Poland. The Contractor shall deliver the approval certificates or the EC Certificate of Conformity at the latest on the date of delivery. (i) The buses delivered on the date of signing the transfer and acceptance protocol should comply with the current vehicle registration regulations and must have the necessary documents allowing for the sale and registration of vehicles at the Department of Communication of the District Office. (j) The buses should be delivered to the headquarters of the Zawiercie Municipal Transport Department, ul. Poland 21 together with repair and maintenance documentation, software licenses necessary to operate purchased buses, i.e.: ⁇ warranty cards for vehicles, ⁇ warranty books, ⁇ service books (reviews). k) If, between the time when the Contractor submits an offer in the procurement procedure and the performance of the contract, there will be a change in the legal provisions regarding the registration, approval, sale or entry into service of a new bus (as well as teams and components for this bus), the Contractor is obliged to perform the subject of the contract taking into account these changes. l) The buses offered may not be prototypes and must be brand new, i.e. manufactured not earlier than 2025, not used for presentation, testing and similar purposes, unregistered, with a mileage of not more than 3500 km. The buses which are the subject of the contract shall: ⁇ be adapted to the needs of all users, including being accessible to persons with disabilities in accordance with the described technical requirements, ⁇ the bus rolling stock will take into account the requirements and good practices set out in Annex 2. Accessibility standards for cohesion policy 2021-2027 in the Guidelines for the implementation of equality principles under EU funds for 2021-2027; ⁇ the purchased rolling stock will take into account safety issues, in particular for non-motorised road users (including women). The rolling stock will incorporate solutions to assist the driver in protecting pedestrians and cyclists (including women), e.g. collision warning systems; m) have solutions resulting from the GSR2 standard - tyre pressure and temperature monitoring system , - turning assistant to the right , - middle belt assistant , - driver behaviour monitoring system, - active cruise control coupled to the braking system , and other bus safety systems required by law at the time of vehicle registration . 5. The Contractor undertakes to provide the Contracting Authority with a guarantee for vehicles subject to the contract without a mileage limit: a) for paint coating - a minimum of 5 years, b) for the body of the vehicle, and in particular the exterior and roof plates, floor plates, doors and covers - a minimum of 5 years, c) for the frame of the truss of the body and truss / chassis frame - a minimum of 5 years, d) for other assemblies, systems and components of the vehicle with equipment - a minimum of 5 years or 375 000 km.
