The subject-matter of the contract is set out in detail in Annex 1 to the SWZ – Description of the subject-matter of the contract. The contracting authority requires that the details given by the contractor in Annex 2.1 to the SWZ – Tender form – detailed part clearly and precisely indicate the subject of the contract. The data provided must allow the Ordering Party to unambiguously identify the subject of the order in terms of configuration consistent with the requirements of the Ordering Party using generally available methods (e.g. model of the subject of the order and the name of the manufacturer, link to the description of the subject of the order, website address, etc.) in order to check the correctness of its parameters with the requirements of the SWZ. In the event that the model or name of the subject of the contract provided by the Contractor does not fully illustrate the fulfilment of the requirements of the Ordering Party, the technical data regarding the configuration and accessories of the subject of the contract should be indicated. The Ordering Party allows to offer the subject of the contract with parameters exceeding the requirements of the Ordering Party, with contemporary technological requirements, meeting at least the minimum requirements set out in Annex No. 1 to the SWZ and not inferior in terms of quality and technical conditions, while maintaining its appropriate functionality and purpose. The contracting authority informs that in accordance with Art. 4 of the Public Procurement Act, if the description of the subject of the contract includes a reference to standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and sec. 3, The Ordering Party allows solutions equivalent to those described. The warranty period for all items of the order is 60 months. The warranty period will be counted from the date of signing the final acceptance report of the entire subject of the contract. The warranty period will be equal to the warranty period. A detailed description of the conditions for the performance of the subject of the contract is contained in the Model Contract constituting Annex 3 to the SWZ. The Ordering Party provides for the possibility of introducing changes to the content of the concluded contract in relation to the content of the offer on the basis of which the Contractor was selected in the following scope: 1) changes in generally applicable legal provisions or resulting from final decisions or final administrative acts of the competent authorities - insofar as it is necessary to adapt the provisions of the contract to the existing legal or factual situation; 2) force majeure - understood as the occurrence of an extraordinary, external, unforeseeable and preventable event, which could not be avoided even with the utmost care, and which prevents the Contractor from performing his obligation in whole or in part. In the event of force majeure, the Parties to this Agreement shall use their best endeavours to minimise delays in the performance of their contractual obligations as a result of force majeure; 3) change the subject of the contract to the subject of the contract with equal or higher parameters while maintaining the prices indicated in the contract, provided that the Contractor makes such a request to the Ordering Party and demonstrates that circumstances independent of it occurred, which - acting with due diligence - he could not foresee, and the newly proposed subject of the contract meets the requirements of the Ordering Party; 4) changes in the date of execution of the subject of the contract for reasons attributable to the Ordering Party. Making the above-mentioned changes requires, under pain of nullity, the maintenance of a written form (annex) and a written request of one of the Parties for amendment together with a justification.
