Description

The purpose of the Contract is to provide a comprehensive training service consisting of the preparation and delivery of specialised training Procedure for the application of supervisory measures in the framework of group supervision in the EU (legal aspects) taking into account the provisions of the Solvency II Directive as part of the technical assistance project PL0435 “Strengthening the administrative and institutional capacity of the Authority of the Financial Supervision Commission for the correct implementation of the acquis in the field of the financial market” co-financed by the Norwegian Financial Mechanism. The beneficiary of the project is the Polish Authority of the Financial Supervision Commission.
The contractor will prepare and provide a specific 1-day training course on “Procedures for the application of group supervision measures in the EU (legal aspects) taking into account the provisions of Solvency II”. Participants in the training will be staff of the Authority of the Financial Supervision Commission in a group of around 20 people.
Form of training: seminar.
The scope of the contract also covers the rental of rooms with technical and operating equipment, the provision of a catering service and, where necessary, the provision of translation and simultaneous translation services, as well as the development of training material for the trainees and the provision of training material in electronic form to the Contracting Authority, with the possibility of making it available to the designated audience.
The Contractor shall submit to the Contracting Authority, for acceptance, a proposal for a time limit for the training within 3 days from the date of signature of the Contract.
The detailed training programme will be drawn up by the Contractor on the basis of the detailed issues set out in Annex 1 to the ToR and will be subject to written approval by the Contracting Authority within 5 days from the date of signature of the Contract.
The training will be organised in Warsaw and the detailed location will be communicated by the Contracting Contractor no later than 3 days before the scheduled date of the training.
The training will last 8 clock hours, including 2 coffee breaks and lunch breaks.
Training may be carried out by no more than 2 trainers per day. The training will be provided in Polish or English with simultaneous interpretation.
The Contractor shall not bear the travel costs of the trainees.

In accordance with Article 144. 1 The contracting authority provides for changes to be made to the terms of the contract in relation to the content of the tender on the basis of which the Contractor was selected in one of the following circumstances:
(a) in the event of a change in the legal or factual situation affecting the content of the contract concluded;
(b) in the event of personal changes on the part of the Contractor or the Contracting Authority;
(C) where there are any objective changes necessary for the proper performance of the subject matter of the contract, where such modification is in the public interest.
(D) in the event of a delay, not attributable to the Contractor, in the performance of the contract due to the need for the Contractor to modify the subject matter of the contract following the comments referred to in points IV (1) to (3) of Annex 1 to the contract, the Contracting Authority shall allow for an extension of the deadline for performance of the subject matter of the contract.
