Description

The subject of this contract is the purchase of personal protective equipment, immobilisation equipment and medical equipment for a neonatal ambulance. A detailed description of the subject-matter of the contract is set out in Annex 2 to the Tender Specifications. The subject of the contract is free from physical and legal defects, brand new, not previously used by third parties, in particular, it did not serve as an object used for demonstration purposes and is of good quality. It has also not been reconditioned before. The offered medical devices covered by the subject of the contract must meet the requirements set out in the Act of 7 April 2022 on medical devices (Journal of Laws No. Journal of Laws 2022, item 974 as amended). The marking of the supplied materials, instructions for use, product descriptions must be drawn up in Polish. The Contractor undertakes to perform the subject of the contract in accordance with all the requirements of the Ordering Party indicated in this SWZ. The contractor must submit a tender for the whole of the lot(s) selected, taking into account all the items in the lot. All requirements set out in the procurement documents are minimum requirements and their fulfilment is mandatory. Failure to meet the above-mentioned minimum requirements will result in the rejection of the tender as inconsistent with the terms of the contract pursuant to Art. 1 point 5 of the Public Procurement Act. If the Contracting Authority indicates in the description of the subject of the contract trademarks, patents or origins, sources or a specific process that characterizes the products or services provided by a particular Contractor, it is permissible to offer solutions equivalent to those described, provided that they maintain the same minimum technical, quality and functional parameters. Where reference is made in the description of the subject-matter of the contract to standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and sec. 3 of the Public Procurement Act, the Contracting Authority allows solutions equivalent to those described. The Contractor who invokes equivalent solutions is obliged to demonstrate that the solution offered by him meets the requirements specified by the Contracting Authority.
