Note: Not all information for this procedure were successfully computed. Please consult linked documents for more details.
The contracting authority, on the basis of Act No. 131/2000 Coll., on the Capital City of Prague, as amended, performs the management of real estate owned by the Capital City of Prague in the territory of the Prague 12 district. The contracting authority has the following properties under management owned by the City of Prague: • land on Komořanská Street (‘Komořanská Street’) and • land on Písková Street (‘Pisek Street’), which are described in detail in Annex 8 to the tender specifications. In the locality of Komořanská there is an apartment building, popularly nicknamed "Hamburg" from the 1920s, which was used after its establishment as an object with service apartments of the nearby Modřany sugar factory. The existing building is not in good technical condition and does not correspond in volume to the functional needs of the new project. In the Písková locality, there is a building that housed the office of the Prague 12 district until 2021. The building is in a technically and morally unsatisfactory condition and is not prospective for residential use. The contracting authority intends to implement the project for the construction of apartment buildings in the above-mentioned locations with the possibility of placing commercial premises on their ground floor. The contracting authority assumes that this project will be implemented as the subject of this public contract by providing the land in question to the contractor who will build apartment buildings on it. In exchange, he will have the right to lease or partially sell apartment buildings (or individual units within apartment buildings) for a certain period of time and collect income from end users from this activity. The award of this public contract is aimed at finding a solution respecting the principles of the concession, which would correspond to the ideas of the contracting authority and respect all its requirements, as well as the requirements imposed on the site addressed by the legislation and the zoning plan. The formal intention of this public contract is to conclude a contract for the performance of the subject of the public contract with one selected supplier, which is ranked first on the basis of the evaluation carried out in accordance with the evaluation criteria. At the same time, the chosen solution must respect and comply with all legal regulations regulating the construction of similar building units. Expected subject of performance: When launching a procurement procedure, the contracting authority is objectively unable to define all the technical conditions and the legal and financial requirements for the performance of the contract in such a way as to enable it to draw up the procurement documents. The only thing that the contracting authority is able to define is the presumed subject matter of the contract. The envisaged subject of the public contract is, in particular, the construction of apartment buildings in the Písková and Komořanská localities, as new buildings, which will mainly perform the function of housing (main functions) and possibly commercial function, exclusively on the ground floor of apartment buildings (additional function). Part of the performance of the public contract will then be the operation of the built apartment buildings for a specified period of time, from which the selected supplier will be entitled to take the fruits and benefits. The contracting authority is also considering various variants of the ownership regime. As part of the tender documentation, the contracting authority submits the contracting authority’s intention forming Annex 8 to the tender documentation (‘the contracting authority’s intention’), which, in general terms, expresses its idea of the subject of performance of this public contract and defines certain binding parameters. In the Contracting Authority’s Intent, the Contracting Authority also lays down minimum technical conditions within the meaning of Section 180(7) of the Act. The information provided in these tender documents is intended, among other things, to enable participants to form an idea of the expected future subject of performance and, where appropriate, to assess the appropriateness of the solution also envisaged by the contracting authority at the time of drawing up these tender documents. This will include the possibility for participants to express their views (to ‘react’) on the requirements envisaged by the contracting authority, which the contracting authority may subsequently take into account when drawing up the final procurement documents. For this purpose and for the purposes of negotiations with the contracting authority during the dialogue phase, the participants are required to prepare a proposal for a solution (hereinafter ‘proposal for a solution’) drawn up on the basis of the specifications contained in these procurement documents, supplemented, where appropriate, by other documents that will be part of the call for negotiations in the competitive dialogue that will be discussed in these negotiations with individual participants. The content of the Solution Proposal is set out below in this tender documentation and may be specified during the procurement procedure. The draft solution shall be submitted by the participants to the contracting authority prior to the first discussion in the dialogue phase. At the same time, the contracting authority does not exclude the possibility of co-financing the subject-matter of the performance of the contract in the course of the procurement procedure.
