RO-Sfântu Gheorghe: credit granting services
Contracting a revolving financing of RON 40 000 000 with successive drawdowns, with a maturity of 24 months, with ROBOR 1M + procedural points applied by the bidder in excess of the ROBOR 1M interest, which will aim to ensure the pre-financing necessary for the implementation of public investments of county interest. The public procurement contract will be concluded under a suspensive condition, i.e. it will enter into force and will take effect between the parties, only if the contracting authority obtains the favourable opinion of the Commission authorising local loans on the contracting of this reimbursable financing, in accordance with Government Decision No 9/2007 on the establishment, component and functioning of the Local Loan Authorisation Commission, as amended by Government Decision No nr.145/13.02.2008.. In the event of failure to meet the suspensive condition, i.e. if the contract for the credit line is not authorised, the contracting authority does not obtain the favourable opinion of the Commission authorising local repayable financing, the credit line agreement concluded with the tenderer who will be declared as the beneficiary, shall be terminated with retroactive effect at the very moment of its conclusion, with all the legal consequences resulting from this situation. The public procurement contract to be concluded constitutes information of public interest and will therefore not be subject to banking secrecy rules. These specifications will constitute other mandatory clauses of the public procurement contract.
