Description

The Rems-Murr district, as the competent authority and authority pursuant to § 6(1) and (3) ÖPNVG-BW in conjunction with § 8a PBefG and Article 2(c) of Regulation (EC) No 1370/2007, intends to award a public service contract (ÖDLA) for public passenger transport services by motor vehicles pursuant to § 2(1) PBefG. The contract will be awarded through the open pan-European competitive tendering procedure.
The subject of the proposed ÖDLA is the public passenger transport services in line bundle 13 ‘Outer Murrtal transport area’. Route bundle 13 shall include at least the services of the following bus lines:
Line 375 Murrhardt –kirchnkirnberg – Kaisersbach
Line 380 Sulzbach – Großerlach
Line 380A Sulzbach – Zwerenberg – Eschenstruet – Sulzbach
Line 385 Sulzbach – Spiegelberg – Wüsten Red
Line 386 Sulzbach – Spiegelberg – Spiegelberger sub-orte
Line 390 Backnang – Sulzbach – Murrhardt
The services included at the start of operations (see section II.2.7) are described in the Supplementary Document (see Section VI.1 C). On the basis of the current planning, the total number of services to be awarded is 901.641 km of utility per year.
The ÖDLA refers to local public passenger transport services within the meaning of § 8 PBefG (scheduled transport pursuant to § 42 PBefG).
The ÖDLA will contain provisions allowing the transport offer to be adapted within the framework determined by the ÖDLA to changing transport needs or financial conditions and to the local transport plans as amended, as well as to other changing circumstances.
The operator is granted an exclusive right within the meaning of Article 2(f) of Regulation (EC) No 1370/2007. The exclusive right is intended to protect the transport services which are the subject of the public service contract. All bus services required to fulfil the ÖDLA are protected. The exclusive right protects the service in question from traffic which not only impairs the passenger potential of those services in so far as they are not initiated by the contracting authority itself. It includes benefits in accordance with Paragraphs 42 and 43 of the PBefG.
The Rems-Murr district complies with the publication obligation under Section 8a(2) of the PBefG in conjunction with Article 7(2) of Regulation (EC) No 1370/2007.
