1. The subject of the contract is to provide support and update of the Fudo Security IT solution including the functionality of monitoring and recording remote sessions related to IT systems and the provision of other services. 2. A detailed description of the subject of the contract is attached as Annex 2 to the FTZ. 4. Detailed conditions for the provision of services have been included in the Model Agreement constituting Annex 5 to the FTZ. 5. The Contracting Authority, acting on the basis of Article 95(1) of the Public Procurement Act, requires employment by the Contractor or Subcontractor on the basis of the employment relationship of all persons performing: a. activities of a person appointed by the Contractor as responsible for servicing the Agreement, indicated in § 10 of the Agreement, consisting, among others, in ongoing contact with the Ordering Party and the Entities, b. activities consisting in handling and managing Service Applications submitted by the Entities, on the terms and to the extent specified in the Model Agreement constituting Annex 5 to the TMS. 6. The meaning of the terms used in this FTZ is identical to the definitions adopted in the Model Agreement constituting Annex 5 to the FTZ. 7. The Ordering Party accepts as an equivalent solution the provision of the System for recording remote sessions together with the Replacement Equipment necessary for the proper functioning of the System in accordance with the description of the subject of the contract and the transfer to the Recipient and Units of ownership of the Replacement Equipment together with the Software (equivalent software, other than FUDO Security) and granting or ensuring the grant of perpetual licenses to the Software necessary for the proper functioning of the System. In this case, it is the Contractor's responsibility to develop an Implementation Project covering the installation and configuration of the System and integration with systems currently functioning at the Recipient and in the Units, to launch and configure the Substitute Equipment and Software based on the assumptions of the Implementation Project in 12 independent locations of the Units, together with the migration of all data and all current configuration including permissions and existing recordings, to carry out station instruction for up to 6 people on the functioning of the provided Equivalent System and its administration in 12 independent locations of the Units, to grant a guarantee for the period from the signing of the System Implementation Acceptance Protocol until the expiration of 36 months of providing Technical Support services, under which service will be provided for the delivered and launched System together with the Equipment necessary for the proper functioning of the System, to perform the Post-Executive Documentation.
