The subject of this publication is the conclusion of discount agreements pursuant to § 130a(8) SGB V for medicinal products for the active substance fluvastatin (WHO ATC code: C10AA04) as part of an ‘open-house model’. All interested and suitable pharmaceutical companies are offered a discount agreement in accordance with Paragraph 130a(8) of the SGB V, subject to uniform conditions and a uniform access procedure. There is no exclusivity. The quantity to be purchased is unknown when the agreement is concluded and depends, in particular, on the demand of insured persons, changes in the number of insured persons, on the regulatory behaviour of contracted doctors and on the dispensing and stockpiling behaviour of public pharmacies. The contracting authority does not guarantee minimum quantities of purchases.
The agreement may be concluded at any time and under the same conditions. Individual contractual negotiations are not carried out.
Interested pharmaceutical companies can request the participation documents (discount agreement and form referred to in III.2.1) via the e-mail address given in I.1 above.
Agreements under this model will be concluded between 15/08/2016 and 30/09/2018. Interested parties must submit the fully completed and signed participation documents (self-declaration of reliability and rebate agreement) for the first time by 15 August 2016 and then by the 15th of one month to the entity mentioned under I.1 below. Access to AOK PLUS is important. If the 15th of a month falls on a Sunday, Sunday or nationwide public holiday, the next working day shall replace such a day. The rebate agreement will enter into force on 1 October 2016 at the time of signature by AOK PLUS up to and including 30/09/2016. When signed after 30 September 2016, the rebate agreement entered into force with AOK PLUS’s signature. Signature will take place by the end of the month in which the documents are received by AOK PLUS. If it is received later (after 15 August 2016 or after the 15th of a month) the submitted participation documents will be taken into account on the 15th of the following month.
Participation documents can be submitted for the first time by 15/08/2016.
In organisational terms, AOK PLUS requires approximately half a month in advance in order to report on the rebate agreement. The initial labelling of discount medicines in the pharmacy software starts from the second month following the deadline for receipt of the documents to participate. This time may vary in the event of changes or changes to the deadlines for the cut-off date notifications in the national AOK contract notification portal DatRabatt.
A discount agreement is concluded with all pharmaceutical companies that meet the eligibility requirements and confirm this by signing them on the requested documents.
The contract will end on 30/09/2018 at the latest, irrespective of the date of conclusion of the contract. The non-exclusive rebate agreements concluded in the open-house procedure serve to bridge the period between the expiry of the patent of active ingredients/active ingredients and the entry into force of exclusive discount agreements pursuant to Section 130a(8) of the SGB V. The AOK PLUS – Die Gesundheitskasse für Sachsen und Thüringen reserves the right to replace the non-exclusive open-house rebate agreements with exclusive rebate agreements during the term of the contract. With the entry into force of tendered exclusive rebate agreements, the open-house agreements will automatically end. The experience of AOK PLUS after exclusive rebate agreements will normally enter into force 8 to 12 months after the publication of the relevant notice of invitation to tender in the Supplement to the Official Journal of the European Union. Future open-house contractors are invited to consult regularly in the Supplement to the Official Journal of the European Union.
