This assignment covers the analysis of Regulation (EC) No. 1393/2007 of 13 November 2007 on the Service in the Member States of judicial and extrajudicial documents in civil or commercial matters (‘Service Regulation’) and Council Regulation (EC) No. 1206/2001 of 28 May 2001 on cooperation between the courts of the Member States in the Taking of evidence in civil or commercial matters (‘Evidence
Regulation’). The present report provides the findings relative to the Evidence Regulation. The results of the evaluation and impact assessment concerning the Service Regulation is provided in a separate volume. The two main objectives of this study are to: - Carry out an ex-post evaluation of the Regulation on taking of evidence and their practical application; - Carry out an impact assessment for a possible future initiative aimed at addressing the shortcomings identified, in particular to modernise judicial cooperation in civil and commercial matters.
