This report presents the findings of the Study on Evaluation of Regulation (EU) 2019/1150 on promoting fairness and transparency for business users of online intermediation services (hereafter, ‘the P2B Regulation’). The objective of the study is to provide inputs for the Commission’s first review of Regulation (EU) 2019/1150, including an overview of its implementation and an evaluation of its effectiveness, efficiency and coherence. The P2B Regulation is the world’s first horizontal regulation covering platform-to-business (P2B) relationships. It aims to ensure ‘the fair and transparent treatment of business users by online platforms, giving them more effective options for redress when they face problems, creating a predictable and innovation-friendly regulatory environment for online platforms within the EU.’1 The Regulation became applicable on 12 July 2020. The analysis presented in this report reviews the current state of play with regard to the Regulation’s implementation and effects, two years after the P2B Regulation became applicable, in the context of an increasingly regulated platform economy in the EU. It is based on extensive data collection and analysis; a consultation exercise comprising over 300 interviews with various types of stakeholders, four international focus groups, and a business user survey carried out in eight Member States; a review of the terms and conditions (T&Cs) of 300 selected platforms; as well as a literature review and extensive desk research.
