La Commissione europea si è avvalsa enormemente dei poteri discrezionali conferiti dal regolamento sul braccio preventivo al fine di ridurre gli obblighi di aggiustamento, sia stabilendo le relative norme attuative sia adottando decisioni caso per caso. La Corte ritiene che la combinazione tra gli attuali parametri della matrice, le deviazioni consentite e le clausole di flessibilità indebolisca
cumulativamente il valore-obiettivo stabilito dal regolamento, ossia ottenere un aggiustamento medio annuale dello 0,5 % del PIL nell’arco del ciclo. Ciò impedisce il conseguimento degli obiettivi a medio termine degli Stati membri entro tempi ragionevoli. Particolarmente allarmante è l’aggiustamento lentissimo o addirittura inesistente in diversi Stati membri con un elevato rapporto debito pubblico/PIL. Le norme attuative e le pratiche adottate dalla Commissione devono pertanto essere riviste e rafforzate.
