Publication metadata
Article 11(1) of the Batteries Regulation (EU) 2023/1542 (‘BattReg’) requires that, for products incorporating ‘portable batteries’, it shall be ensured that the batteries are readily removable and replaceable by the end-user at any time during the lifetime of the product. (Regulation (EU) 2023/1542, 2024a) Article 11(2) of the Batteries Regulation specifies a few cases of derogations from Article 11(1) where products incorporating portable batteries still have to be designed in a way that the batteries are removable and replaceable, however, only ‘by independent professionals’. Article 11(4) empowers the European Commission to add additional derogations through the amendment of Article 11(2). (Regulation (EU) 2023/1542, 2024a) To this end, the European Commission published a call for applications for derogations at the beginning of 2025, allowing stakeholders to request derogations for specific products. Requests had to be submitted by the end of April 2025. In total, 81 applications were submitted, some addressing multiple applications. Against this background the European Commission has requested Oeko-Institut and Ramboll Germany to support in assessing the applications.
