This study will analyse how damage caused by artificial intelligence (AI) systems is allocated by the rules of tortious liability currently in place in the EU, and whether – and if so to what extent – the national tort law regimes differ in that respect. In light of the peculiar challenges of AI systems presented by their characteristics, including connectivity, autonomy, data dependency, complexity, openness, and opacity, we will also examine possible gaps in the laws as they are when it comes to the protection of those harmed. Solutions to be expected on the basis of current European tort laws, also with respect to damage caused by AI, are assessed after weighing the conflicting interests in such cases, which impacts upon the application of liability rules. The study focuses only on key aspects of selected problem constellations that serve to highlight key aspects of civil liability. The presentation is therefore limited to a core outline of the key features of applicable liability rules that distinguish the tort laws of Europe. It does not attempt to strive for an even partially comprehensive review. Significant disparities are shown on the basis of illustrative examples from selected European legal systems representing different legal families, with an obvious starting point in Germanic jurisdictions due to the authors’ background.
